This is despicable realy. Why not go to spain where the minimum age is 14 ? First mistake.

Why does everyone jump to sexual motives, maybe he is showing her the architecture or something like that.

Maybe it is because he has not sought the consent of her parents?

Also, if it was a legitimate trip, I am sure there are avenues he could have gone down but I think it is likely that his requests would have been refused without some kind of chaperone in place and certainly not without the prior written consent of her parents.

Ah, that only counts if he/she is under 16 regardless of consent i.e. "Unlawful sexual intercourse" which that page is about. The bit you quoted made it look like, if there was a huge age gap, they would prosecute irrespective of both parties being >16 (or 18 if position of trust involved)

That doesn't matter. If a UK National does an act which would be contrary to the SOA 2003 if committed within the UK then they commit the same offence as if they were in the UK. International boundaries don't come into it - http://www.legislation.gov.uk/ukpga/2003/42/section/72


This was primarily brought in to stop people going to places like the Philippines etc and doing the act without fear of prosecution when they come back home a'la Gary Glitter
 
it's illegal to have a sexual relationship with a student who is under 18yo. so if she's 16/17. police will still want him anyway

But as said before, France's age of consent is 15 but there are rules governing that which include those in positions on trust (like teachers) not being able to abuse the law, I'd suspect the same happened in Spain.

I remember a girl of 15 in my school was seeing a teaching assistant, although we didn't know the full extent of their relationship. She wasn't a stupid lass either and I'm pretty sure they aren't together now.

He got nicknamed Tweedo the paedo, no teacher ever found out. Apart from a few that was it.

I hope they find her safe and well, not sure what his motives are though.

That is awful, likewise I don't think this girl is stupid either. She could simply be going through a tough time or just confused.

I would be lieing if I said I never had a student who didn't have a crush on me, and believe me I am no George Clooney.

When I was teaching adults I did have a brief relationship with an ex-student. She was 39 and I was 37 however lol. She adored me as a tutor but sadly as just another human being both of us failed to find the same spark.
 
I don't think it's about age in this case it is about trust and professionalism. The teacher should in no way put himself into the position of falling for (however innocently or not) one of his pupils. He should have recognised the signs and dealt with them appropriately.

In a sense it is no different to him shafting one of the other teachers, it is unprofessional and puts him in a compromising position in many ways.

He is their to teach not to find romantic relationships of any kind.
 
On another note, all this media coverage is probably not helping. If there was a chance they were going to use those return tickets, it's probably gone now that he fears the lynchmob and she thinks she'll be grounded.

Yes sorry I should have been more accurate. I quoted the CPS website based on the fact the girl is below the age of consent, so if any sexual intercourse (not sure how that is legally defined these days) has taken place they will go after him, more so for the fact he has a duty of care to her as his student.

However, even if she was 16 and consented they would still go after him because I was under the impression it is a criminal offence for him to engage in sexual activity with her until she is 18 whilst she is a student at the school he works at?

edit: At the end of the day the law is the law, and if you start applying fuzzy rules then it's impossible to manage. Yes not every girl who turns 16 is mature enough to have sex, just as every girl who is 15 isn't. Fundamentally though the guy abused a position of trust and authority which does play a part in these things. She may well be in love with him, madly and deeply, or just think she is, but on the whole the Law criminalising this sort of thing does more good than harm.
