4 Months Jail for 'Offensive' T-Shirt

Forget the t shirt for a moment. This guy had a 12 month suspended sentence hanging over him, then pleaded guilty to another offence. That's always going to get you jail time no matter what the second offence is.

Someone wearing the same t shirt but without prior convictions or a suspended sentence would have been prosecuted for a public order offence but would not have got a custodial sentence.
 
So where do you draw the line between 'free speech' and 'incitement to hatred'?

I'm all for free speech, but you can't go around insulting everybody just because of some ill-perceived 'right' to do so. The guy was parading around in a T-shirt designed to provoke a reaction - he got one and pleaded guilty to a public order offence.

I'm not saying that the laws are perfect, but I cannot understand what defensible position there is for what this cretin has done.

As for the chap - perfect example of pond life, inbred scum. It's sad that people like him exist.
 
There doesn't have to be one. It's not about him or what he's done. It's about freedom of speech. You either have it or you don't, and if you don't protect offensive speech you don't have any freedom of speech. It's a matter of whether you think the benefits of freedom of speech outweigh the costs of it or vice versa. It's not about agreeing with any particular piece of speech. Quite the opposite - the test of whether or not you approve of freedom of speech is whether or not you would allow speech that strongly offends you.

As I said earlier, freedom of speech is not binary. It's not a case of either you have it or you don't. As with so many things in life there are varying degrees of it.

To think that this argument boils down to whether or not you agree with freedoms is to grossly simplify the issue and misrepresent reality. It just isn't that simple and if you believe that it is, then I don't think you really understand the issue at all.

But that is the whole point, what public order offence? For expressing an opinion? A particularly nasty one sure, but it is not inciting any hatred or violent action so I cannot see why it is illegal. Stupid yes, illegal no.

If you look up and see what even the Director of Public Prosecutions has said

"People have the right to be offensive, they have the right to be insulting, and that has to be protected."

Stand up comedians have been worried for some time about this sort of thing, think how offensive some of their routines are. Roy Chubby Brown anyone? (probably not a good example as maybe he should have been locked up! ;):p)
 
Have to say it's too much IMO. It's terrible thing but most people would see it as exactly that. Community service I would say. I'm a fan of free speech.
 
This is starting to become worrying that people are being jailed over saying trivial things others don't agree with. The person with the T-shirt is a ***... not a criminal. The law needs to respect peoples rights to be a *** if they wish.

I can see why he he's happy there's one less "pig" on the street, however someone has died so it's completely wrong and sad.

And then there's the BBC exposing it to the world. How many people would have seen his T-shirt otherwise? several dozen? The BBC has basically given his t-shirt world wide exposure to millions with the views rising every second even after he's in jail now, but the man is already in jail for showing it to a hundred? Ridiculous.

It is wrong, vile disguisting etc etc but I it shouldn't be illegal. For those saying about the suspended sentance, he has been jailed because he pleaded guilty but he pleaded guilty to something that shouldn't be a crime.

Does this mean I could be arrested for wearing a t shirt that says **** -> ?
 
Thinking about it some more it makes even less sense, taking the hang Mark Bridger group, that group is wanting something done so therefore is inciting hate/voilence whereas the tshirt was passing comment on something passed. Unless you want to count that people him of punch him for wearing the t shirt but I don't think inciting hate and violence against yourself should be a crime haha.

I suspect you could. A policeman would ask you to remove it or cover it up, and if you didn't you would be arrested. Regardless of what you think of the law it doesn't allow complete freedom of speech or expression in this country.

Unless you allow people to express whatever they want without exception (which is a valid position to take) a line has to be drawn somewhere which will always be a source of disagreement.

I'm glad he got 4 months!, he is a complete idiot IMO!.

People who don't agree with this just remember when a loved one or a work friend die's or get killed you will want something to be done about it if an idiot did something like that!.

I don't like people who **** off the police!, some of you don't know what we have to do every day and what we see!, Yeah sure i signed up to it and i knew what i was taken on
by doing the job but it don't give you the right to **** off the police when you don't know how short staff we are and being threaten with knifes and guns!.When i leave my house
every day i give my kids a kiss goodbye and i sometime thing this could be the last time i see them as i'm going to a knifing or shooting! as anything could happen!.

I don’t understand why people are posting saying he should go to jail for being an idiot? Yea good idea let’s just bang up a good few people for just being idiots.

In the UK we are going crazy with what can be and can’t be said, I really hope it settles down and they can actually start looking at things rationally. The Facebook guy got jailed for a comment when Justin Lee Collins who is a famous public figure who was charged and found guilty with actual harassment was given community service and a fine.

Somehow what you can say or wear is more offensive than actually causing harm directly to a person these days.
 
This isn't as bad as the guy prosecuted for the April joke.
He posted it on his own wall and was pretty much victim of a witch hunt. It wasn't even a public comment really before people started posting it everywhere.
This guy sure is an idiot but it's a huge waste of public money prosecuting people for this. In my opinion the barrier for prosecution should be so high that you should only be prosecuted if you continue to harass the same individual.
