Got a bit of a dilemma,

My son recently was driving a friend moped in a private car park without a helmet, stupid I know but this was barely going 10mph.

Traffic cop came and handed him a 60 pound fine and 3 points so we have appealed the decision and it has been over 3 months, is there a limit until the appeal is void?

Sorry, don't know the answer to your question. But your son should've took it on the chin and paid it.

edit - just read the 'private' car park. Depends on how 'private' it is I spose.
 
What? Caught red handed breaking the law and you want to appeal.

Stop reinforcing your sons criminal ways, make him pay the fine, and discipline him.

And what law is that then? If it was on private land as suggested he hasnt done anything wrong :confused:
 
I think you'll find it's only in pretty exceptional cases that a car park would be considered not covered by the road traffic act.
 
So if my car was locked in the garage ive not yet built and s decided to play my favourite cd in the car and drink some beer I would still be liable to get told off for drinking and being in charge of car?

Since when was your locked garage a 'Road to which the public have access'?
 
Are we going to play out endless silly hypothetical situations now?

What if your car was infact no the moon and had illegal undercar neons fitted?

Yes he has? Road Traffic Act applies to all roads to which the 'public have access'.

OP said private car park, if it is a private car park then it may not apply.
 
I saw this on TV once. It does apply, and it's at the discretion of the traffic officer to decide if they want to warn or ticket. Never the less, by trying to appeal you're undermining the very reason why this is illegal. Riding with no helmet is dangerous, even at 10mph you or a passenger can fall off and bump your noggin pretty bad.

Chalk it up to experience and remember to be safe in the future!
 
Silly boy. It's going to end up costing you more. Really doubt a traffic officer has jumped over a fenced private car park to ticket your lad. The public wil have had access hence the rta applying. Feel for you :/
