Hi,

Just abit of help. maybe no one is a lawyer on this forum bit i have just done something DEAD stupid.

I have just gone and signed well a few weeks ago a purchase order for my gutters to be fixed. now its for £1900.00 I asked the bloke before signing if i dont get the money before ( because i was borrowing it ) is it ok not to processed even tho am signing. like a n00b i signed because he said YES its fine, If you dont get the money its not a problem. we will cancel it. So i signed the form, NOW! am not able to get the money the company are coming after me for half the money for no work, Or all the money for the work to be done.

do i have a leg to stand on because i signed the form? even if the bloke said it doesnt matter ( not in writing ) and my g.f heard him say it too? Will that stand up in court? as the company are going to take me to court?

I know i am not going to get a lawyers answer just want to know what others think!

dont most contracts have a 14 day cooling off period , when if you dont want something
you can send them written notice of this and the contract is null and void ?
 
i have left it far to long and its out of the cooling period now :( left it for 4 weeks. They tried 4 times to come and to the work and cancelled on me 4 times! it says in the terms they can try up to 6 weeks which is 6 weeks in 3 days but i have put them off 1 ( they have put me off 4 times saying builders are sick and so on.
 
If they can prove that they've made purchases necessary to carry out the work for you, then you won't have much luck.

I can't understand why they would require half of the money for no work done if they've either a) not purchased anything or b) already have the necessary equipment for the work.

e: If they've got their own rule that the work has to be completed in 6 weeks and it isn't done then it sounds like that is your way out :)
 
It just states this

We reserve the right to delay installtion by up to 6 weeks after the agreed installation date.

even if i have not contacted them for dates - should they have contacted me and tried to offer me dates?

the works should have been done on the 8th of oct
 
Were you using any medical or are you still using any medication, do you have some form of mental illness if so then you can get out of it.

If not then you can take the chance that they will not go to court, but you can say that you felt pressurised and intimidated at the time, the chances are they will not bother to go to court.

Anyway as others have said you have 3 days dont contact them, and play it by ear, if you do get a court summons then you could just pay up but until then best thing is to wait it out.
 
He was made assurences by a representative of the company at the time that what he asked would be the case.

If they refuse to honour that then the service was misrepresented and he has every right to refuse to pay anything now.
 
thanks for the help and advise, i am going to a solistor tomorrow would write more about it but not had much sleep cus of it and need to try and get some sleep

Except one party has a written, signed, contract... the other nothing if it is denied. It isn't the best position to start from.

Nip down to citizen advice.....its free and know better than internet geeks....rofl.

No seriously go there. They might even phone the company for you to officially tell them to do one.
