Where do I stand?

Sound like you need some proper legal advice mate. Is there a citizens advice bureau you can contact? Or was this agency members of any governing bodies like ARLA?
This is starting to sound like they are trying it on and stealing your money which in my book is fraud. Either you are entitled to move into the property or you are entitled to you money back, plain and simple.
Get a copy of the tenancy from the agency that shows you have right to move into the property or speak to the police again claiming fraud?

I've asked and all they have provided me with is a picture of something taken on an iphone.

They are a member of TPOS it would seem.
 
I would speak to TPOS asap and explain the situation just to get the ball rolling. Having a very quick look at the site, have a look at the code of practice - 4a, 6b, 6c, 6d, 6j and probably more.

If everything you have said is true and the landlady has nothing in writing from the agency regarding you moving or reference etc, I would think they are way off the mark with regards to the code of conduct of the ombudsmen.
A quick copy and paste from their site..

"Registered agents must follow The Property Ombudsman Letting Code of Practice. This sets out the framework within which registered agents must operate and the standards of service they must provide for both tenants and landlords.
The Code is compulsory and is rigorously applied in our complaints handling.
The agent is required and has agreed to have Professional Indemnity insurance to ensure that any compensation awarded to you can be paid.
The agent is required and has agreed to have an in-house complaints system with written procedures; inform you how to refer any unresolved dispute to the Ombudsman and co-operate with any investigation by the Ombudsman.
The agent agrees to pay compensation, in full and final settlement of a complaint, if this is awarded by the Ombudsman and is accepted by you as the complainant. This award must be paid promptly. The maximum that the Ombudsman can award is £25,000."

This is good news of sorts, it won't help you in the short term but at least you have a safety net for the long term resolution of the situation :)

I would keep a written log of any phone calls that have taken place and probably put everything in writing and recorded delivery for your own protection.

But they said it was a civil matter when I called them!?

Go to the police station and insist. Make a formal complaint. I suspect the police were previously referring to who has right of tenancy to the property. But the situaion is now different - you were denied tenancy but the agent still has your money. It may therefore be theft.

Spoke to TPOS today and one of those Telephone legal advice services.

TPOS can't investigate the legal side of things or offer legal advice, but can only investigate the treatment side of things.

Legal advisor said that I had a good case but had to do things formally....so I think I am going to take the legal route.
 
Jeez, you let this thing go on and on.

Decided to go legal with it, good luck you may get your money back in a year.

I would be at the Agency offices demanding my money back with some friends as backup and if that failed demanding that the police took this up as straight forward fraud / theft.
 
I would send the GF for food and squat until i had my money back and ample compensation and i would have called the cops as soon as they started bringing thier relatives down.

What do they need thier relatives for when they already have letting agents being abusive?Sounds like you moved into a right scummy area mate.Let me guess 5 heavies with anchor tatoo's telling you to leave?

If any of them even touch you its instant assault.And if you have the keys then well stuff them.Also how can the agent tell you that you wont get a refund when you have nowhere to let?


What does he think or who does he think he is taking money for nothing.
