Hello guys, I think I've been scammed so here it goes (And yes I know I'm a gullible fool, and I won't be fooling for this again)...

Basically I went on Gumtree found a phone I was going to buy, messaged the guy, and he found out he had sold that one, but had another one to sell, I was like ok, got his name, address, bank details, email and even a picture of the phone with his name besides it.

20th Feb he replies, "Hi yes. Sorry I couldn't make it to the post office in time because I have a go appointment and I am still here now. I will have to do it tomorrow first thing in the morning. I will be able to give you the tracking information by noon"

21st Feb he replies, "Sorry cant use phone at work. I will post to you as soon as I leave work I have the phone with me and will do it on my way home. Thanks"

Who does this, I thought a scammer would just get my money and that's it, not bother replying or anything.

I've texted him 6 times since that last reply, my last reply was "Your last chance to respond before I contact the police, Gumtree and the bank.".

I'm going to ring him later on, and if he doesn't reply I will contact Banks, Gumtree and the Police.

Anything else I should do?, thanks.

Should have used the link in your signature to follow buyers advice when buying second hand...

Saying that I've BT'd people on forums and currently on facebook (which is taking extra time due to getting replacement in) but I trust owing to looking at previous posts and friends in common in the fb case.

When he phones you from the Emergency room where he took his 6 month baby after a horrific accident involving Circus clowns you'll not be able to sleep at night.

If he had another one to sell, then its basically nothing to do with gumtree, you contatced a seller, arranged a private sale, for goods you had not seen, then you sent him money with no contract or agreement to sale, and now he is keeping your money.

Do you have an address for this person?

Never pay by BT on Gumtree dude, it's always got to be done by cash simply because there's no feedback system on gumtree (I may be wrong).

Yes.

And I didn't arrange a private sale, it was him that arranged it for me, and he posted a picture with his name and the phone, maybe if you bothered to read my first post in this thread....

And when I call him, it just goes to answering machine.

You waited a whole 2 days before going ballistic threatening police?

I've promised to post something then not been able to for longer than you waited.

The fact is he hasn't replied to any of my texts, If I'm going to sell something, and the buyer wants a question answered, I'm going to answer it.

I had this problem once with Gumtree, except I was going to drive 10 miles to pay him cash in hand. He didn't want me to test the iphone at his house (Probably didn't want to reveal his address or perhaps the Iphone's wifi was not working)... he wanted me to test it at the local McDonalds, what a waste of space...

Be extremely cautious when using gumtree, it's full of scammers.

I'm really sorry to have to say this but there is a high chance that you are dealing with a scammer.

I'm going to call the bank on Monday, but is it even worth calling the police since it wasn't the actual advertised ad? :S

Id be surprised if the bank can do anything, you initiated the bank transfer so from my experience they will do sweet FA really ie a few yrs ago i paid by bank transfer for something in the members market, unluckily for me i got the account number wrong...rung my bank up and they said sorry because you initiated the transfer there was absolutely nothing they could do. So someone got a few £100:p.

Next time pay cash and dont do bank transfers, you will have absolutely no leg to stand on if things go wrong.
