Do I have a case to fight this parking ticket? Photos included.

Morally the OP is in the wrong. The lines are clearly double yellows. However if it were me then I would definitely appeal and I think there is a good chance of winning.

If a driver appeals and wins then it shows the council were in the wrong, not the driver.

Except that hes admitted he knows he was in the wrong, no-ones excusing the council. What he should do is pay the fine and write them a letter with it explaining they should be maintaining the road better.

This morally bankrupt ideology is the reason our country is actually bankrupt (I know not actually but you see what I mean).

When someone has been genuinely been hard done by, yeah.

Not when someone has tried to be a chancer, done something they knew they shouldn't have been doing and then when caught, doesn't have the stones to just take it on the chin and wants to avoid all responsibility for their prior actions.

That's a nice way of thinking if the councils were always scrupulously fair and honest in their enforcement, but as many of us know they definitely aren't. They're always happy to dish out fines on technicalities, so until they start using a bit of common sense (or even abiding by the law as was the case in one of the tickets I appealed....) I'll encourage anyone who gets a parking ticket to appeal it.

So the arguement is "because theyre doing it im going to do it too", nothing will ever change if people take this attitude. Fair enough if something has been given unfairly then appeal it, but the OP knows hes wrong, he should man up and take it.

The Council will only let you off if they know they are wrong and not just because you appealed.

I had something similar 2 or 3 years ago where the Council actually went to where I was fined and repainted lines and put new signs up but I didn't get my fine back because I paid it immediately instead of appealing first (more fool me).

But the basis of the argument is it wasn't clear when the OP has stated he was clear he should not have parked there. I fail to see your point other than you are implying if he forgets that fact he might get off. If these pictures are provided in court it will be a clear case of parked on double yellows. I can see them and any majistrate will see them too and if the OP is asked did you know you should not park there he can confirm what he said above, or lie on court.

We all do things wrong, if we are know we are wrong and get caught we should man up and take the dues. The mind set of technicalities is annoying when one knows they did wrong.

Those are double yellow lines. The ones in the OP are not. You will almost defintiely win an appeal.

Sometimes in life it is easier to back down even when you know you're in the right. I'd apply this to you parking there in the first place. Yes you're in the right and you won't have to pay a fine, but seriously, it it really worth all the agro?

HOWEVER, if he did appeal and won (even if he did think he was originally in the wrong) then the law must be on his side.
I have zero idea if those double yellow lines are illegal or not but the Council would know and wouldn't back down if they knew they were OK.
 
It was silly to park there, but I'd bet money on the fact you'd win the appeal. Double yellow lines must be unbroken, which these clearly are.
