Anyone taken a tradesmen to court?

They always say not to pay ANY money up front, the reputable builders will have credit to buy all of the materials themselves and cash in the bank to cover wages until the work is finished.

If the guy you payed £3k to is one of those cowboys and is playing the system then even if you take him to court and win he's not to forced to pay up.

to be honest I dont think he would want to risk his part P registration so will pay up. I am not that fussed about the money more that I just dont want to let him walk over me.
 
As mentioned earlier in the thread it also seems a big risk bearing in mind there was another £12k waiting for completing the job. Maybe he realised he was out of his depth? All seems a bit bizarre to me.

My guess is if threatened with legal action he will offer to come back and complete the job rather than repay the deposit, but it sounds as though (understandably) other contractors have been appointed so that avenue won't be open to him.

Yah I dont even want him back now, I emailed to ask if he wants to come back but he did not respond. The work will be done by the middle of next week anyway.
 
UPDATE

Today the judge ruled against him in "Default of defence" and I was awarded the full £1,693.00 and £120 costs which is what I had put in a claim for.

EDIT: Hopefully he gets some bad press from this as well, put him out of business ;)
 
Been following this thread with interest, good you won, but I wonder how long before you get your cash or if you'll get your cash.

The court has ruled in your favour and shown that he is in the wrong... I'm not sure he could take you to court if what you write is factual... (basically everything you've written here - and it is factual as the court has ruled in your favour... prior to that it could have been 'hear-say' and open to interpretation i.e. you told half a story)...

Name and shame...

Maybe get on to rogue traders and inform them of him... If this is a common thing with him and they get enough complaints then they might pay him a visit. Others might not have what it takes to see it put through the courts.

Nice one, sadly tho even tho you have a judgement theres nosaying he will pay up.

If not, consider calling in the sheriffs, they were awesome on that BBC show :)

To be fair I do not think he is an out and out scammer. I think he probably got a job closer to home paying well which would have saved him hotel costs and saw it as an easy £3k for under a weeks work.

I have sent him a letter asking him to pay me within 7 days. If he does not I will get the bailiffs on him.
