Was chatting to a mate back in the UK and he was stopped for doing 70 briefly in town racing between a set of traffic lights. Given I don't live in the UK anymore I didn't really know what to say lol. What is the likely outcome? Was stopped by the police and has to go to court!

In NZ it's all very different, so would be interesting to hear how things in the UK work! I told him in NZ it would be an automatic 6 month ban. No idea about UK though... Thoughts? He has no priors in 15 years of driving but had a stupid moment apparently!

It depends if the speed was properly registered or not. If it was measured on some kind of device, he won't get off lightly. If it's the police saying "you were going rather fast there, we were travelling at 50 and you accelerated away", then I'd suspect 6 points or similar.
 
If the racing can be proved then it can be dangerous driving which carries a mandatory 12 month ban
 
For the speeding? In all likeliness a Ban + Fine.

If a charge of Dangerous Driving is being pursued on the racing side of things then a custodial sentence is available to the court and can be deemed appropriate. It would be unlikely in a no injury situation if it is as described. Disqualification is mandatory however.
 
Why would they pursue a charge of Dangerous Driving, which is very very difficult to get, when there is a seperate offence of Racing on the Public Highway?
 
Likelihood is it'd start at a dangerous driving attempt and one of the lesser charges would actually be brought

70 in a 30 if its properly registered is never going to look good, add in the fact he/she was racing another car and the least I would expect is a short ban, hefty fine and lesson learned
 
Was he actually racing or did you mean it in a 'he was racing around' sense to imply he was driving quickly? If he was actually racing another car then he's likely going to be bent over for it.

If it met the threshold test for Dangerous Driving then CPS would pursue it. If there was decent evidence such as speed recordings, CCTV, significant statements by drivers and witness statements describing their manner of driving that fell within the scope of DD, they would run with it provided that it was a prolonged act of driving far lower than what was expected etc. But CPS is a strange beast, some counties CPS would be happy to go with it, when another would try for a lower charge, probably Careless driving as it'd be easier to get a tick in the box.

Because you go in for what the evidence can support and open up 'lesser' offences if suitable.
 
Well having got caught for 96 in a 30 I can tell you they don't like it.
I very narrowly scraped past getting a dangerous driving charge.
Ended up with 12 month ban.
I suggest the OP's mate get a barrister ;)

Cheltenham has a dual lane one way circuit and is (or was, I think it's very calm to what it used to be like in the 90's) and every young un, including myself used to race round town :o
How no one got seriously injured I'll never know. Plenty of walls got knocked down I can tell you that. :D

I even witnessed one in my rear view as he tried and failed to go the same speed as me round the bend :D

Someone around here did it recently and got a 48 day ban... 48 days :( and £150 + other costs.

In general though seems to be a few months to a years ban and a few 100 fine. (Except in cases where it would be exceptional hardship, etc.).

Off topic but relevant question: if you get a 12 month ban does that mean after 12 months you have to re-take your tests or do you automatically get your full licence back?
