Legal advice - Fined for being stuck in a lift...

There has to be more to this story, if everything went as you described and you had fire dept as witnesses the administration of the building would be scared of you suing them, not try to claim costs against you. Either there is more to this story or you were trapped in RyanAir headquarters building and it's just part of their standard "let's try it on" fee roaster.

Isn't it why you pay a maintenance charge?

If it was only a short holiday rental then presumably no. Sounds as though it's the breakages deposit they are after, although as others have suggested some evidence that the lift didn't just break down in normal would seem to be required to justify taking the money.

Ok, I have more information.

Apparently they have an engineers report which states that the lift triggered an automatic stop because there was a jolt, which he/they claims was caused by someone jumping in the lift. However there is no actual evidence that we were jumping which we weren't.

They have already charged the card 280 euros which is a credit card and they are refusing to back down.

Did he give a credit card as deposit card?
If so he should claim that he didn't authorise it. And if it's a debit card he can also do that

8 people in a lift? Jeez the rope could have snapped.

Surely the lift was not well maintained if the emergency button never worked.

State the payment isn't authorised, chargeback the deposit, they won't attempt to follow to England to claim.
Name and shame them, report them to watchdog.

On the other hand, 8 lads in a lift on holiday, I'd bet someone jumped ;)

What was their response to the failure of the emergency button?

If you are 100% sure you were just in a lift and chilling out and it broke down then get whoever's card it is to tell the place that they don't consent to them charging his card, in writing. Then when they go ahead and take the money get the bank to deal with it.

They have taken 200 euro deposit we paid on arrival and will charge the extra 80 euro if not paid tomorrow morning. So I guess it was authorised.?

Maintenance- is there a period of time in which they need to be serviced/ checked?

8 of us in a limited space, movement yes- jumping no.

Immediately get him to report it as an unauthorised charge. Your mate cannot report it to the police himself, the card company can however. The bank must refund the payment immediately unless it has evidence that there is a reason to refuse a refund.

Escalate the charge if they refuse to refund.

Next, contact citizens advice.

Shouldn't judge people by your own standards, but yeah someone prolly jumped ;D. And it still can't be proven, so get your money back and if they take you to court then take it all the way to a trial by Jury, and tell the company this too, because then when they tell their lawyers they will get advised that no Jury will convict based on no evidence.

If you're sure you're losing the €200 either way then get on the curry, the beer and the kebabs with the chilli sauce and protest the charge in a dirty way.
