EVGA already stated they helped put Rivatuner out in the first place, and paid for some of the coding.

Who really cares if some of it is leftover in this new release?

All EVGA are gonna do now is repackage it to remove any old lines of code with rivatuner in it. They probably didn't even think that there would be a problem that's why it was left in the first place. Just a load of people jumping on the hate train.. More and more common on the internet these days..

I can understand the usual AMD fanboys trying to make issue over it as EVGA is one of the best Nvidia vendors, hence AMD fanboys see it as an opportunity to score points. Beyond those types, nobody else will care :p

EVGA for allowing a third party to supply something as vital as the overclocking software for their GPUs, this is something that should have been done in house from the start.

Unwinder for not having a proper binding contract for doing the work for EVGA.

I was going to make EVGA complete surprise and give small panic to new PX 15 "developers" with Afterburner 4.0.0 announce.

Unwinder for not having a proper binding contract for doing the work for EVGA.


And all this about a free tool or tools, the difficulty to develop I shall guess is actually fairly low (set parameters, read from sensors etc)

Afterburner Extreme, not available to the public if I recall correctly.

Basically allows a wider range of extreme overclocking options like increasing the voltage up to 1.8v. As you can imagine making it public would mean idiots would brick their cards.
 
If Evga are good with the warranty and don't stitch anybody else up then I think people are overreacting, wait till a new card comes out with a really nice cooler and they will flock back in like sheep.

Unwinder will have been happy with his fairly standard contract, why wouldn't he be? He's a clearly obsessive guy who decided to write the world's most popular overclocking program and give it away for free.

Just because some companies decide to employ expensive lawyers to try to provide little holes in the contract so they can pretend they have justification in nicking his code doesn't mean that morally they can.
 
guru3d is such a dungheap. I go there to nab drivers but it's so antiquated. At least they have drivers is what I tell myself so I keep going back to nab those.

Absolutely. I'm sure you wouldn't be an arse if people kept demanding you do something when you've already explained it isnt going to happen. No, not you. Never. Takes far more than that for you to throw sensibility out the window, doesn't it?

I think EVGA have done absolutely the right thing for their customers, they have dumped Unwinder and taken responsibility for the software that their cards use to run.

As to Unwinder he only has himself to blame whether it was a weak contract or the fact at some point EVGA would realise with their resources that they could do a much better job.

What on earth are you talking about, the fundamental disagreement here is that EVGA are using Unwinders work, if they stopped using his software and simply made new software, that is fine, that happens all the time. You can't have a contract that prevents a company replacing your software and it's absurd to suggest he had a bad contract.

The issue between Unwinder and EVGA is NOT that they stopped using his software/paying him, it's the fact that they appear to be using his software(or enough of his idea's for it to count as using his software) and not paying him. If so, EVGA are simply breaking the law, doesn't matter what contract you have if someone wants to steal your software and stop paying you. Unless he had the same resources as EVGA to go at them legally then you stand no chance. Billion dollar businesses have gone bankrupt fighting even bigger companies for stealing of IP... Creative outspent is it Aureal(i forget the name). They stole their IP, everyone knew it, but they held up the court case till the company went bankrupt. Once you run out of money you can't win any more because you literally can't fight any more.

Talking about blaming unwinder or having a weak contract.... this isn't a contractual issue.
