thoughts on this situation:landlords/renting

So you're saying that most people who rent a property don't bother cleaning it? :confused: Are you sure you don't just mean students :p

This is what I thought until I experienced so called professionals being messy as well I.e leaving water on work top, crap in the sink and other muck. Not as bad as student but still bad :p Is this how people would live in their own home? I don't think so
 
Heck my rental with a professional in after 8 months has a cracked pvc door, a couple holes in the wall (foot size), stains on 8.5 month old carpets. Its horrific.

All down to the person but I suspect most won't have much respect as its not their property.
 
Basically they have said we are welcome to stay and start a new contract as it's a misunderstanding on "both of our parts" (but they put all of the real blame on us over email), To be honest they are totally uninterested in the "break in" aspect of my original email as they are disputing what happened (our word against a polish woman with broken English) and are saying it was legal anyway as they had text my girlfriend to inform her on a number we no longer have (that one bit is our fault) and as their email system was down at the time they could only get to us by mobile (although they didn't text me).

Basically I see no point in taking any real action against them as I have zero time to arrange to move within 13 days so am screwed into renewing with them albeit at higher cost (as mentioned above they can get more for it and sadly , it's true and the market is a bit crazy at the moment so I don't disbelieve them in that regard).

Thing is, in renting, customer service just isn't a thing and I've learnt a very important lesson in that when you email them with a question it has to be the most watertight one you can have and with no room for interpretation and you'd better hope all of the method's of contact they have are up to date otherwise they can use it against you.
 
According to you, neither you or them have served notice to each other so I am struggling to see why you need to move out in two weeks?

Basically because the guy is a total idiot and reads my Girlfriends email that says "we are looking around and were wondering" as "we are going to move at the end of the contract"
No amount of me telling him how the two are not the same thing is going to work as he is a total idiot.

He says that that constitutes us giving them notice and as we are paying under the odds anyway we will pretty much have to pay market as the owner want's all the flats at the same rate (and we are paying the least out of the 9 in the house).
 
Pretty much yes, Because they have taken the original email as us giving them notice and the real bitch here is that I don't have the time to find anywhere else and even if I did at the moment it's going to be exactly the same size but further out of the centre and a massive pain in the ass.
They know this, I know this.

Ultimately I have to wait until pay review in December (I was promoted last month) before I can actually afford something I want for the long term.

They have agreed a 6 month break clause as well as a provision that if I want to move out before that I can pay a £300 commission fee and they will get another tenant and release me of the contract.
 
Give CAB a quick ring I doubt its plausible to actually read that sentence as giving notice(assuming its word for word what was sent).

It's probably the case they're strong arming you into paying more money. There must be something protecting tenants from this.

Edit: actually if your contract is up for renewal then the emails are somewhat mute (as much as they were a holes). If you signed up for another term then you'd have to pay the expected rate. Or try and negotiate a compromise.

Now its time for renewal you do not wish to pay the going rate ?

I dont see a reason as to why youre angry.
 
I spoke to CAB earlier and they said as there was a lot going on I should speak to Shelter instead as they would offer better guidance than they can.

Other lesson here is if I'm renting via an agent again, it's going to be sizeable one rather than local as your complaints go no where otherwise.

A)Entering without a fair amount of time for us to open the door
B)Trespassing when being told they can't come in
C) No use of email to arrange visit when we didn't respond to text and when its the preferred contact method
D) Only texting one of the numbers they have
E)Using the whole thing as a means to raise our rent knowing full well that they have us by the balls as they can decide we have given them notice to leave when we disagree that point and we have no time to arrange anything else

You dont need to seek shelter lol.
Even if you have given them notice they cannot physically come and remove you, they need a court order first and then it would be the courts bailiffs and that would be months away.
Either renew at their asking price or look elsewhere but dont feel rushed.
You do have time.

They have no right to force you to renew for 12 months or move out in 13 days. The minimum notice period they can give you is two months from the end of the contract (assuming that's the next monthly rental period). And there's no way an informal email can be taken as legal notice.

Firstly Eliot start writing LETTERS to the agency not emails and not phone calls. Letters are a recognised form of communication that you can have proof of sending. Next if you are still in your AST then you don't have to move out till the end of the contract, and if you don't want to move out then you can either renew for another 12 months or go onto a Statutory Periodic Tenancy where you have the same terms and conditions but you can give 1 months notice and the LL can give 2 months notice.

So what, it's happened, no point crying over spilt milk, just change the locks, problem solved, it can't happen again. Your main problem isn't the Polish woman coming in(no point dwelling on that) it's the increase in rent, either you accept the increase in rent or you start looking elsewhere - they can't kick you out in 13 days... they have to give you 2 months notice minimum. If you wanted to be a **** then you could stay longer than that even and get them to start proceedings if u need to delay things.

Personally I'd look elsewhere if the rent is too high.

That's the problem though, They are saying that the email sent by my girlfriend effectively says "we want to move out when the contract ends in October" which to you and me might not but to them it's clear as day (or a way they can make more money with BS loopholes)

You do realise they don't have a leg to stand on?

Legal notice has to be given formally in writing ( I am sure this will be written into your tenancy agreement).

They cannot just say "oh you emailed us this but we assumed you meant this so get out or pay up"

Seriously, if they have not given you formal notice, in writing that you have 2 months to vacate the property, you have nothing to be worried about.
