Yes I think sexual assault warrants 9 months in jail. Especially the degradation caused to the victim by the video being shown to other parties.

Still something that is in jest to my misses, might be considered jest to friends. In fairness she might have been drunk so might he, and nothing came of it.

The fact that some busy body called the police after seeing it a year after the incident, is hardly humiliating her with a private video.
I doubt she thought much of it, probably didn't even know it had happened.
