Time to start looking for another job. Its blatant gross misconduct in the companies eyes and you will be dismissed.

Depends how much his manager values them and/or believes if they were doing it by mistake or not.

Unfortunately the only situations I have much knowledge on involved easily proved cases where people were using it to make a profit so can't really offer much advice.

If it had just been the odd time (it would probably have not triggered an investigation anyhow - IIRC its about 2 grand a year at one company and 3 at the other before they look into it) it would probably have been a slap on the wrist and told not to do it again but if its every time or nearly every time they are going to need quite some convincing it wasn't intentional.

EDIT: I am surprised that people can still fall foul of it though and no steps taken to make sure staff are aware after all this time, its a pretty easy one to do accidentally the odd time if your not thinking about it.

I've read over your post and the comment about having a memory less than a week long confirms your a bit shifty. Also there's a lot of dodgy stuff in there. I would fire you without batting an eyelid.
 
at best you've been mis-informed and made a mistake, and at worst you've been a naughty boy/girl and got caught. just be honest and take what comes. i'd be suprised if you keep your job, these days people see the worst in others.
 
Does seem like abuse of staff discount, fair enough if you did it once or twice but 10 times is gross misconduct.

Offer to pay the discrepancy back and hope you get away with a disciplinary.
 
Well even if all the cards were £20 and what we suspect is correct you've (unwittingly) stolen £40 worth of stock. Saying between £20 and £70 it could be a lot more. I'd be livid if my business lost £40 but then again I'd have to accept some fault if I hadn't taken steps to block such transactions.
 
Unfortunately the issue is not with buying the gift cards, it is then using the gift cards yourself to apply another discount to goods from your employer. I can see why you're being investigated for gross misconduct and this is why you have been suspended. If they accept you were truly naive in not realising that applying a double discount to goods through this loophole was wrong then you may avoid dismissal and end up with a final written warning...however and I can't stress this enough, there is a real risk you will be dismissed for gross misconduct attributed to theft from the company. This will have a potentially significant impact on you gaining future employment in the short term. I would, if you are able, consider finding alternative employment and resigning prior to any disciplinary action...it will depend on how easy another job is to find, your position in the company and whether you have suitable union representation, but I would seriously consider my options here, if I were you.

It's a messy one, the company should have checks in place, no benefits /offers should apply when buying a gift card would be an obvious one.

Equally you have been taking full advantage instead of flagging up the loop hole.. This wasn't a one off act.

Not sure how this will go..
 
You abused the discount system through a loophole and the company will not see that as anything else but gross misconduct. I would seek out a union rep if I were you.
 
I would look at your contract with regards to staff discounts... Whilst reading it, I knew what you were doing and could see it a mile off, did this not flag p with you that it might be potentially dodgy?

Abused the discount system is a bit harsh... If this was a very regular thing then yes, but from what I gather there have been times when you haven't double dipped? Big slap on the wrist, and loss of staff discount is probably fair I think (based on what you have said).


EDIT: to expand on this with another thought, I know some palaces strictly limit staff discount to staff (and not relatives). You might want to check this as they will have allowed gift cards to be bought by you as a gift, but not for you to buy actual products for other people.

Isn't it this part that's the issue. Unless I'm reading IT wrong you got 20% off the gift card then a further 20% off each item bought via the card.


Like Mynight said, if that's the case, and this is how I've read into your post. It sounds like you're applying 2 lots of discount, which from my point of view is common sense not to do this. Just because the system allows it, doesn't make it right. Just the same as someone doing 70mph in a 30mph zone, just because you can do it, doesn't make it right.

Another thing to consider is who is the discount allowed for, is the 20% for just you or, you and family, or you family and friends? If the 20% is solely for you and you only then admitting to giving these gift cards as presents to family/friends may work against you as you'd be technically giving your discount away and possibly breaking company policy.
 
oh dear. sounds messy to be honest.

they think you spot a loophole and took the advantage of it. i would start find another job right now
 
Surely it all depends on what the contract / policy is? If there is nothing black and white to suggest that this is clearly against the company policy then they won't have any concrete grounds to get rid?
