eBay, sorry!!

Bet this is asked a 1000s times but I keep getting my post deleted on the eBay community forums as I am naming and shaming a person! :confused: I am only asking for help!

Anyways just after a bit of advice really,

Bought a D&G Watch for the GF for Christmas using eBay and a guest PayPal account, she used my PayPal so didn't want her to see the transaction.

Here is the listing;

New with tags: A brand-new, unused, unworn and undamaged item in the original packaging (such as the original box or bag) and/or with the original tags attached. See all condition definitions.

I used the mobile app, so didn't see the full listing description. This is where I have gone wrong as this is what the description says;

gorgeous dkny silver watch...would say new without tag..in immaculate condition..

beautiful watch for every occassion three links removed...can be fixed back..pls note only 1pin available..but should fit even big wrist

box a bit damaged but stll presentable

The picture of the item in the listing does look new and all the rest of it, however after receiving the item this morning I am a bit gutted;

The box is very tatty and dirty, ripped in one corner.
The watch has clearly been used and worn, the straps have a lot of scuffs.
The back of the watch is scratched
The tags are very old and tatty.

I paid £97 for the item and for £10 more I should have gone with an actual watch seller :(

Just don't know where I stand, I used PayPal guest so don't have a resolution centre, I have emailed PayPal about how to request a refund.

Do I have a right to a refund? All a bit of a mess really.


Once again, very sorry its so hard to post on eBay community as my post keep getting deleted its very heavily modded which makes it impossible to write what I have above!

Item isn't new, whilst they have marked it as new.

I reckon you have a case for full refund. Ebay protects buyers now more then ever. Have you raised a case with them?

Also, is it D&G or DKNY as that doesn't match
 
Yep ^ it doesn't matter what the description is, the item is "not as described" as they have incorrectly listed it as new under the condition when it is not. "Item not as described" is pretty much an automatic full refund situation.
 
The thing is I can't go through eBay,

We can't process your request at this time

You purchased this item as a PayPal guest user and will need to contact PayPal directly by going through their Resolution Centre.

So I have to email PayPal and wait for them to get back to me! Not sure how its all going to work!
 
Why are you stressing, relax you've got a cut and dry case even if eBay/PayPal weren't a complete walk over just contact PayPal and it'll be sorted quickly and easily.

Have contacted PayPay, but its so hard to find the correct information on eBay and the community board is pants.
 
Just log into ebay and go to the resolution centre and raise a case ebay will do the rest. the item is not as described and you will get a full refund as long as you follow the ebay process.

When you return this item send it via Special Delivery.
 
Phone PayPal - had an issue before and after several days of emails back and forth, I phoned them and had it sorted within 10 mins
 
Regardless eBay/ PayPal won't do much unless you can show that you attempted to talk it out with the seller. It's always best to do so even if it is futile.

Agreed as they prefer an amicable settlement so the least they will accept is that you have made an attempt to resolve the issue with the seller.
 
Here is the correct procedure if you run into issues on Ebay:

1) Message the seller first to see if they will give you a refund, therefore nobody else needs to be involved.
2) Open an item dispute, saying the item is not as described.
3) Phone Ebay. You will have to hunt for the number but both times I've had to resort to this they have been very helpful. You can also phone Paypal (I believe it's the same number).

Naming and shaming the seller before even contacting them is a bit unfair and probably why the thread was deleted from EBay's own community forum.

Posted the add description and listing title, I did not post there username nor link them to the ad.

I then posted another post and that got deleted for saying sorry for breaking the rules and mentioned it got removed!

Maddness, not sure how you can ask for help on there when its so heavily modded.
