Court Case: woman tricked into sex with a woman pretending to be a man

If the allegations are true then I'd say it was a crime but I'm not sure what crime. Could lump it under "assault", I suppose, as that covers all sorts of things. If it's true then there wasn't informed consent so it should be illegal.
 
yeah does sound like it should be sexual assault (AFAIK women can't 'rape')

tis an odd one though...

I mean if a man has sex with a woman while pretending to be someone else then that is clearly rape i.e woman thinks it is her partner who crawled into bed in the dark.... But on the other had if a man claims to be say a professional footballer when talking to a woman in a bar and they then hook up - well that isn't rape. This one seems to fall between the two.

But in this case a woman is pretending to be the "professional footballer" - clearly with the tackle to prove it.
 
Well technically it wasn't part of the accused's anatomy so would a foreign object even if it were attached to someone count as sex since the object wouldn't provide sensation itself to the accused. Surely it was consensual but possibly based on a deception. Whether a crime has occurred therefore relies on whether such a law exists regarding deceiving someone to gain consent for sex. Wouldn't that then expose those that dye their hair or trim some years off their age to also be guilty? Morally I think the accused was wrong but I also think the other woman consented and also had an obligation to know what she was dealing with. She must have liked it otherwise she would have said 'no' during the act. To say she didn't approve afterwards isn't a lot different from not approving of the real thing not being to her liking for whatever reason. Maybe she could argue she was robbed of her dignity etc but would that be a tangible thing in law? If it were, would it be any different to theft by deception aka fraud. That's it fraudulent sex is what the accused is possibly guilty of. Then can it be proved what was said between two people didn't include disclosure of the accused's true identity?

You would think with 2 years of relationship, and at least 5 sexual encounters, you'd be more "understanding" than going to press charges for sexual assault.
 
I'll tell you what happened....

They were both enjoying a lesbian affair when a 3rd party found out and in an attempt to save her reputation(why it matters is someone is bisexual is beyond me) she made up the most stupid story going.

Of course this has backfired and she now looks like a stupid, vindictive liar.

Pretty much agree with this.

I wonder what would be the outcome if a man pretended to be a woman and "tricked" a bloke into sex (let's assume some similarly contrived story about liking anal, or some sort of injury/illness preventing vaginal sex)? Would that be sexual assault too?
 
This has happened before, like 10 years ago.

The woman was a big beefy pig though so was understandable someone fell for it.
 
This is horrible, but the victim must have been the most gullible or desperate person since the dawn of man. I mean at no point did you suspect something wasn't off....
 
Naturally the alleged victim's identity is not revealed. We don't know quite how vulnerable she was to the apparently predatory behaviour of the accused.


If nothing else, this story reveals to forum members that there may indeed be hope for them yet. Engaging in this kind of deception just to meet a lady is wrong, of course; but it might be necessary to explain why you have to wear a blindfold during sex.
