So incase you weren't aware, the law changes on the 1st October which is summarised below:

ALL private vehicles (including hire cars) must be smokefree if they are enclosed, there is more than one person present and one of them is under 18.

It will be an offence for a person of any age to smoke in a car (or other private vehicle) with anyone under 18 present. And for a driver (including those aged 17 and people with a provisional licence) not to stop someone smoking in these circumstances.

The law does not apply if the driver is 17 years old and is on their own in the car.

good. should be totally banned whilst driving anyway.

probably wont be enforced very well though.
 
Good but no doubt you'll still see people doing it as I still pass what must be 5 people a day on their phones still.
 
I like the fact that a 17yr old can smoke in their own car but anyone over 18 in the car isn't allowed.

That's how I read the BBC's explanation. Also even if the 17yr old driver is sat there smoking his 18yr old mate sat next to him isn't allowed.
 
Nanny-stateism designed to look like a health measure.

As if there's not enough problems on the roads, without creating even more barely enforcable laws.

Why not use Police time to actually clamp down on people driving without licences, insurance, or unfit cars and actually causing a serious danger?

Smoking while driving should be automatic points and fine at the very least.

Agreed should be 100% banned no excuses

He also can't smoke if he has a passenger regardless of age, as the criteria is if any occupant is under 18 and more than one person is present, it doesn't stipulate whether they are driver or passenger.

So they can happily smoke on their own but would have to stop the moment anyone else got in as a passenger.
 
What's the point because it will never be enforced properly. Everytime I go out I see loads of people driving while using mobiles. Nothing will change.
