Filled with wrong fuel

Or the garage diagnosing the issue has made a mistake?

It was towed to the main dealer, they said I can come down and check the results. My first thought though when it happened was that I had put the wrong fuel in as it was juddering and misfiring within a few minutes of pulling away.
 
But surely with the AA report, CCTV + receipt proving you didn't, that's enough for them to at least pay for the repair cost?

I would imagine this to be accurate.

You should surely manage to get a copy of the CCTV no? Does that not come under data protection? Then you will have all the evidence you need.
 
Of course there's something they can do, their negligence has just broken your car (it dind't run, therefore it was broken (pitch it)). I'd be asking for the general manager's phone number and going way up there. You purchased diesel because you have a diesel car, they sold you petrol.
 
Well I got through to the store manager, he checked the CCTV and I've definitely picked up the diesel pump and put diesel in. He said they've not had any other complaints about it so not much they can do.

A signed and stamped document from the dealer confirming this should do

Id be fully expecting them to pay for any repairs and costs I incurred.

Don't accept that - if they have footage of you putting Diesel in, and the AA/garage/main dealer can show your tank has petrol in you've got a good case.

What car was it & how much fuel did you put in? If you put a decent % of the tank in you should be able to show without doubt that there wasn't the wrong fuel in before, nor added afterwards.

If they arn't playing ball it might be a case for your motor legal insurance if you have it.
 
CCTV footage at a pump is not really proof, for all they know OP could have dumped petrol in his tank after visiting their station. The only proof would be if there are multiple people in the same situation making it undeniable.
 
How much fuel did you buy? If it's a fiver, they have a get-out clause. If it's a full tank, you've got a stronger case.

Be polite, keep everything in writing and if they don't respond accordingly I'd consider the small claims court.
 
1. Request a copy of the CCTV footage (you'll need to fill in a data protection form and provide evidence of who you are, i.e. passport/driving licence or similar.

2. Get a formal report from the garage that's done the assessment, and also get an estimate from them for he repair work.

3. Write to the general manager of the store in question to explain what's happened, and what you expect them to do about it. Include copies of the receipt for the fuel, the garage's report and their estimate. They can look at the CCTV footage themselves to verify.

4. See what happens after that
 
Also get a report from the AA to include the time and place you requested a tow and where they picked you up from.

You should then be able to prove that there was no way you could have then gone on and filled up elsewhere with the wrong fuel.

Similarly it would be good if you filled from empty and brimmed it as then again there would be no way of you filling up and then putting more in elsewhere.

Basically you need to prove that there is no other way of this happening.
 
If this only happened a few days ago - either they've been very busy and emptied the tank or there'll still be loads left in it.

If the former, this will have happened to a lot of other people. If its the latter, then can you go back there? Is the pump still available? If its been blocked off, ask them why? If its still in use, get a jerry can and put a few quid in it.

It takes a lot of work and time to empty a tank for a mistake like this, if there's not a huge outcry about it in the local press and whats coming out the pump is definitely diesel then there has to be another explanation

Sure, that could have happened. But there is likely a time stamp on the CCTV footage (possibly), along with a time stamp on the receipt. The AA will also likely have recorded the time of the call, and will have the location details of where they attended.

While it is still circumstantial evidence in reality, I doubt there would be a court in the land that could possibly find against him with all that evidence backing him up.

When you do put a claim in, make sure to claim for the amount of fuel you bought too, as well as the cost of repair, and any other associated costs.
 
I'm going to go round to the petrol station and get a copy of the CCTV, I'll phone the AA as well for a report on it. Tesco are flat out denying any responsibility. I had about 30 miles left in the tank and only put £20 in.

Just heard back off the garage, they've flushed it but still have two permanent faults showing. One for an injector, one for the fuel pump. They recommend changing all the injectors at a total cost of about £3-4000!!! The car isn't worth much more than that being an 07 plate Leon FR with 115k miles. Luckily I'm borrowing the missus car this week, but next week I'll need to hire a car, didn't take out that option on my insurance this renewal.. Whoops!

Wouldn't this last paragraph give even greater support for your claim? You paid for diesel, are on CCTV filling from the diesel pump, then you break down five minutes from the petrol station.

I'm surprised the diesel connector fits the petrol one, would have thought they'd make them different to avoid this type of thing.

The local Sainsbury's has each one colour coded with writing big enough to red across the car park. :D
