What is the Justice rationale behind this court's decision? Teenager avoids jail after raping a 5 ye

My daughter is 5. Just thinking about some greasy teenager doing that made me feel physically sick, so I can't imagine the rage if I were in that family's shoes!

I imagine they could appeal but it makes you wonder how they come up with these sentences.

You are thinking about this the wrong way!

(As does the justice system)

He is insane!

The unfortunate thing is that the legal system has a very limited idea as to what Insane actually means.

Prisons are full of people who are mad as hatters but will nevertheless be released in 2/3 years to inevitably re-offend.

He should be treated as being insane.

(IE incarcerated in a secure facility until (If ever) he might be regarded as sane/cured.)

The Legal Industry however relies on repeat offenders for their bread and butter! So letting them out again is a basically guaranteed revenue stream! :(

So that is where we are!

(I do have some understanding of insane people. Many years ago, I had a lady friend who was schizophrenic. Initially I though t i could help her, she was after all intelligent, artistic (very much so actually) and cultured with it.

Unfortunately she was also completely bonkers! (I do not meen this as an insult in any way)

After trying to kill one of her neighbours because she thought they were putting poison in her milk she ended up in a nursing home.

(Thank goodness she didn't end up in a prison!)

I haven't heard from her for a while (She may well be dead by now), but I did keep in touch for 30 years or so, so I still feel I did my duty as a friend!

This is pretty outrageous. This is totally inappropriate - Gilly

But seriously, while I wouldn't ever want to see capital punishment come back, this little disgusting piece of scum should be locked up for many many years and have all civil liberties removed. A 17 year old who is capable of rape is capable of any other serious crime and genuinely pose a threat to society, even if there are mitigating circumstances (mental illness etc).

What? how can you look at a child and consider it "sexy":confused: I feel physically sick now.

Pretty sure it's a joke. As indicated by "but seriously" immediately following it.

It's a reasonably well-known joke as well. I laughed.

I think the Judge who effectively 'Let him off' should be jailed as an example to other Judges that this sort of behaviour will not be tolerated. Sickening.

That's actually an interesting point. What provision is there in law for ensuring judges are reliable and maintain some sort of consistency in sentencing?

Is there a report of the kids mental health? Do not wish to point fingers until we see a mental health report which may help explain the situation.

not really - if he's mentally ill and has raped a kid then he should still be locked away from society, perhaps for a longer period even

****es me off how the law provides anonymity to youth offenders purely because of age and not the crime, rape, terror attacks, murder... Name and shame these sods!

Because back then people who committed atrocious crimes such as this, were actually punished, severely. Not pussy foot about like they do now with this liberal bull**** and let people literally just walk away... the justice system now compared to then is a joke.

But does nothing to stop the crime taking place to begin with. Just saying. ;)

But the crimes were still committed. So we were no safer.

Some country in south america, can't remember which, made rapw punishable by death. Rape didn't decrease, but what did happen was the number or rape-muder went up. People had more incentive to kill their victims. So the law made less safe.
