Oscar Pistorius thread

So if he got a 5 year sentence and was out on house arrest after 1, will the same ratio apply to his murder sentence or was that simply because it wasn't a murder sentence before.

not surprising

the judge in the previous case was widely criticised by law professors etc... at the time for contradicting herself, applying the law incorrectly

I've read on bbc (not sure if correct) that she will be the one who actually sentences him?...why? That seems a bit odd if you got the original judgement wrong.

Also says that the sentencing judge can apply discretion to the sentencing even so he may still get away with an easier sentence!

So glad they finally got this right!

He blatantly used the flaky south African laws to off his girlfriend and attempt to get away with it.

Hope he tops himself in jail.

It was hilarious that he didn't get done for murder in the first place.

He intended to murder the person behind that door. Whether it was indeed Reeva, we will never know, but the fact is, he fired multiple powerful rounds at the person and intended to kill.

"the SCA found that the identity of the person behind the door was irrelevant in holding someone liable. " - This should have always been the case.

And this

"South African law is strict on when you can legally fire at someone.

You cannot just shoot - you first need to determine that the threat to your life is real and that there was no other way to mediate that threat but to shoot.

For example, you are not allowed to shoot even if you see an intruder climbing over your fence. "

I just can't fathom how a murder verdict was not reached first time around.

Finally, some justice. Living it up at home all cushy was ridiculous. No idea why house arrest is considered a punishment. His reasoning for shooting her was never believable.

Really? I pretty much believe his reasoning for shooting her.

I also happen to believe that it's still murder.

You believe that he honestly thought it was an intruder in the bathroom when we woke up and his girlfriend wasn't in the bed beside him?

Are you his lawyer?

I have no idea if he knew it was his girlfriend or not, but am I the only one who would also be shooting to kill in such a situation? I don't want to merely injure a potentially armed home intruder, I would want to stop the threat completely.

Let's be honest, there's absolutely no way that he was not aware that Reeva was behind that door.

He simply didn't get his way, lost his cool, she tried to hide from him, and he thought "I'll ****ing teach you bitch" and shot her through the door.

I hope some huge dude with a 14" wang makes him his bitch multiple times every single day he's in jail. When he comes out of jail, nobody should hear him fart, his ******** should just go "hah".

Agreed.

You know instantly on waking whether your partner is in bed next to you. No partner next to you and a noise from the bathroom would make anyone at least consider that the partner is in the bathroom.

Discharging a firearm when you don't know what the bullets will hit is always a very bad idea. Doing so when the bullets may hit another human is manslaughter. Doing so when you know the bullets are going to hit the girlfriend you're mad at is murder.

Yes, in somewhere as dangerous as SA I would be thinking this too, but...

This is more likely what happened.
