Well I'm doing this religiously now. It's really very worrying because yes she is responsible for her rubbish, but at the end of the day if someone steals your rubbish and fly tips it - you are liable if they can trace it to you. What utter nonsense!

We will tell her to get a receipt from the builder (hopefully that says including rubbish clearing), and she also tried calling him when the guy turned up. That together with the text should help. But I do get the feeling the council wouldn't go through with it unless they knew they can get her for it. What makes it worse is that she's not British and with the whole Brexit thing getting a criminal record is not really going to be ideal!

There's so many rules about waste now it's probably easier to fly tip than take your rubbish to a council dump.
I have a few tins of old paint, to get rid of it legally I have to send an email to the council, wait for, and download a form, print it off, fill it in, post it back to them, then wait for them to send me a letter telling me the time and date I can take it in (between 1pm and 3pm on a Thursday) and a maximum of 25 litres of paint in any one month.
And they wonder why people fly tip.

Link to your council's waste disposal www page? That doesn't sound right to me. Not for a non-commercial private individual.

I didn't know what fly tipping was before now, but I take it means dumping rubbish in random public places? Anyway, my DIY friend came around to do some tree surgeon work this week and last. I know it's too late for OP's friend, but what we did was fill his trailer up 3 times (attached to his car) then it was 3 trips to the local skip. So as a non able-bodied person myself and unable to drive, that was how I arranged it. The crux of this is how trustworthy the friend / contractor is.

Some councils spend millions clearing up illegally dumped rubbish. Why should we pay for the Op's friends mistake at not making sure the person getting rid of her rubbish was licenced?

Yeah i msut admit the rules are quite anal. I need to apply for a licence to take a trailer behind my car to the tip. I dont want to put smelly rubbish in my 50k car. I have to wait a week for the licence to come and its only valid for a fortnight so you have to plan ahead as to when you want to go.

WOuld be better if they lasted 6 months or a year and i could just keep a few in the draw,
 
I suppose you could claim to be a *****. After all, when those ****ers illegally set up camp on school playing fields they are seemingly allowed to fly tip any amount of waste, including dead dogs, without any form of legal recourse at all.
 
I can't stand fly tipping, it's a completely selfish act and for what, to avoid a token charge and some minor inconvenience visiting a local refuse centre. It's not much compared to the 000s every clean up costs the council.

Around here they're usually named and shamed in the local weekly newspaper and rightly so. The fines are pretty big too usually in to the thousands.
 
A lot of people could fall foul of this. The prices of skips are so expensive that there are a lot of garden clearance/man with a van type of people. I wouldn't think to ask for a certificate etc and I'm sure most people wouldn't either.

And therein lies the problem. Some dodgy looking guy come round and says "psst. Wanna dispose of that rubbish? Real cheap. Cash in hand no questions, alright?" and people are only too happy to let them take it.

Its getting ridiculous I've even seen them at it dumping waste at the back in the bins area round these buildings, piles of old kitchen cupboards, garden furniture, they come round in the early hours when they think no-ones around and empty a large Luton type van. The managing agents have taken to putting up "No fly tipping!" signs on the buildings, not that I think that'll do much.

Strange at our local one you just put paint with the other chemicals such as coolant and oil, right next to car batteries.
I have found the local tips to be really good. Taken loads of stuff always helpful people to help you with which area to dump what.

I dont put anything in the bins with any identification of any kind on cut it off and burn it in batches twice a year.
 
It's a shame for your friend, but ignorance of the law is no defense unfortunately. There has been a lot of publicity around disposing of waste correctly, I've seen on the radio and TV and in the papers. Your friend will probably appear in the local paper warning even more people to take responsibility of the disposal of their waste so hopefully this kind of thing will become less and less common over time (along with the big piles of rubbish that are dumped around country lanes everywhere).

Visiting a council run tip is like being back at school. I'm not surprised people fly tip.

Where on earth do you guys all live? Up here the council tips are fantastic. I've turned up with all kinds of stuff and they couldn't be more helpful. Never had a problem with any kind of garden/household/construction waste that we've taken. They even have a white good re-use centre.

Erm, no. Because that would be a recorded crime that you aren't responsible for.

What you are responsible for is making sure you use a registered waste carrier to deal with your rubbish - which she didn't do.

If shes explained what happened,And they still dont believe her then surely they will have to have some decent proof before they can REALLY do anything,I mean sure they have her name on things but that doesn't prove she was the one that dumped it there.

Doesn't matter - the householder is responsible for ensuring they use a registered waste carrier to dispose of waste.

It's nothing to do with the actual dumping as has been explained a few times in the thread. You have a duty of care to check that the person disposing of your rubbish is licensed to do so, otherwise you can be fined up to £5000.

If you are a householder, you are required to take reasonable steps to check that people removing waste from your premises are authorised to do so.

Reasonable steps to take:

Ask the waste carrier to provide you with their full address and telephone number.
Ask to see their waste carrier licence issued by the Environment Agency or Natural Resources Wales.
Contact the Environment Agency directly on 08708 506 506 and ask for a free instant Waste Carrier Validation Check, alternatively you can check online on the Environment Agency website.
 
Did you miss the bit where they have her name and address on some of the rubbish?

In all probability, they have empty kitchen boxes with her name and address on!

Surely anyone with a printer can stick your name and address on a few envelopes/boxes/official looking letters and mix it in with a pile of rubbish at the side of the road?
