I don't want to give in as he will probably take advantage in the future and that simply isn't happening.

Those upright bits the bit thats snapped, they do tend to go especially if someone has leaned on them. He may have a point.

Personally I'd offer to pay for the damage or go halves with him. Either way keep it calm and don't get pumped up. Some people are just confrontational and its not worth the hassle of a war of attrition with the neighbours. Been there, done that. It never ends.

The plot thickens. He is willing to accept that my carpenter will fix it (although not accepting liability)

Another issue, we have a shared fence panel which runs from my house to his as seen here - http://imgur.com/a/pG8aC

As you can see, the builder has simply attached the horizontal batons from our house to his and not attached to the fence panel at all. We was going to fit a gate there on our side which means cutting it down and screwing into the post.

Now he is claiming that he has spoken to his solicitor and says that we can't do that as it would affect his half of that fence.

Is this guy serious?

What would you do? Currently trying to contact a solicitor now but don't want to have to pay for something that seems to be clear cut that my half is on my property, so screw him.

So that panel is new and half of it is on his property? Probably should only be a half panel for your side if that is the case as he hasn't agreed to it.

Edit: Misread, so you want to remove the panel and replace with a gate on your side and I'm assuming you would put a half panel back in to cover his side. Plus sorting all the flower bed etc out.

Really don't know on that one, should just be something you two agree on but obviously things are getting heated. I'd say if anything having a shared panel between the houses would be more an issue than separating as you wish.

AFAIK your side of that panel is yours, end of. If there was a door there already and it broke, you would be the one paying for it, not him. The trouble is that fixing a gate there will require you to fix it to his fence or a post attached to his panel. You could be difficult at bury the gate post deep int he ground and let his panel and fence wobble away on the grounds that he said you cant fix the gate to them

The panel was put in when the houses were built but his side is connected by the post on my side (attached to my wall). It's not connected in the middle at all. It's just kind of sitting there. So I was going to take my side down and nail it into the post.

I simply want to take down my side. Pin the rest into the fence inbeteeen and add a shed door on my side. He's claiming that because his side is joined to my side it would ruin the structural integrity of his side even though it would be pinned into the post.

Seems like it could cause a lot of issues. Seek some advice.

If you get no where, paint the fence panel on your side every sickly colour on earth in a striped pattern. Then wait for him to give in and crumble

Can kind of see his point on that, I wouldn't just want the panel to be effectively cut in half. I'd want it to go in to a middle support the same way as it goes in to the baton on your wall currently.

Just another example of new builds cutting corners which make issues for the buyers later on I'm afraid.

Neighbours can be a pain where fences are concerned .. my neighbour took down a 6 foot fence and replaced it with 3 foot of trellis, all because I refused to sell them any of my garden. So I slapped up a 6 foot fence right up next to it as it was before, so she called the police on me TWICE! Police refused to do anything as it was a civil matter rather than criminal. My neighbour hasn't spoken to me in 6 years!

Would be a shame if that fence where you want a gate would fall down next time there's a really strong wind. It can get really strong in between buildings.
