We don't kill enemy combatants who aren't fighting either. If they are still fighting then killing them is just combat. But I don't think that is what Rory Stewart is suggesting.
The point about them not giving up is a very fair one. Guantanamo Bay for all that it was derided was simply an acknowledgement that unlike fighting national armies the combatants would never surrender and needed to be contained until they were no longer dangerous. The US didn't kill every person like this they found.
