Hi, not really after legal advice, just people's experience. Basically a friend is being sued, as a lady posted mail thru the wrong door and tried to get it back by sticking her hand through the letter box and his dog nipped her finger , any idea where he stands?

Pretty sure you're in the clear. Private property, and not on 'official' business (like a postman), and she was basically trespassing by sticking her hand through the box to try to take stuff.

Going forward, though, with a history of nipping fingers, it would be wise to get a cage or something. Could be a negligence issue if it were to happen again after one incident already.

I think that's her own fault - I'd ask her for proof but the moral of the story is not to go poking fleshy bits where you cant see whats on the other side

She's at fault, is the letter box at the bottom of the door? If it isn't how the hell did she think she'd be able to grab the post back.

The dog did nothing wrong, she illegally attempted to gain access to the house the dog wouldn't have just bitten there would've been significant warning, growling barks etc. A strongly worded letter back stating the case from the owners side should shut her up, or counter sue for trespass and possibly get the police involved for attempted burglary.

I wonder what sort of legal team would take up a case like this? No win no fee groups tend to migrate towards sure things don't they (which this most certainly doesn't seem like) which might imply a proper paid in advance type lawyer. Still seems like a pretty open and shut "It was your own fault" type of case though....a dog will be a dog, and fingers through a letter box is essentially an intrusion. Also, what sort of dog was it?

abulance chasing scumbag chancers, that's who.

..she stook her hand into someone elses property (oo er). Surely that's tresspassing no? In which case the dogs response is entirely justified.

Besides, I couldn't imagine going rummaging in someones letterbox, might be traces of faeces in there :(
