78 year old pensioner arrested for for stabbing burglar (burglar later died in hospital)

I hope the poor guy gets off, he's a hero in my book. I upgraded my baseball bat to a machete a while ago, we've had the same gang of human vermin attempt to break in several times, they come armed and they know we have a dog, you can only assume their intent is to kill the dog and anyone who gets their way. Police never have the resources to deal with burglary but they do when a burglar gets hurt.
 
Clearly and sadly the best course of a action to take in a case like this is to not call the police.

If they do come knocking, use the crook standard 'no comment' defence.

Prints on the blade would include the accomplices with a potential witness who saw a man in a van put his hand near some guy sleeping in the street and when he removed his hand if had a knife in it and the guy was bleeding.

Open and shut case.

Instead the old guy is probably (and rightly) self righteous saying it was his right to defend against a burglar etc which will probably end up convicting himself.

If your going to keep it quiet, keeping the knife would be crazy. Melt it down :p

But yea, sadly some of the laws seem to encourage dishonesty with stuff like this.
 
If you force entry, come armed and don't flee at the first sign of the homeowner then the law should offer you zero protection and you should expect the worst including death. Tough luck..

The public backlash if they try to jail this guy will be huge. However I very much doubt that will happen.

No it won't. Don't kid yourself. At most there would be a few mutterings at the workplace or pub and some macro images on Facebook with a few thousand likes and "most of you won't share this!!!!!1111one".
 
Guy should be feted as a hero, not treated as a criminal for defending himself, wife and property.

Sad indictment of how rotten both our police (lack of) and justice system in this country is. Driven by namby pamby SJW's chattering round the water cooler and worrying about LGBT "rights" instead of rooting out the real criminals and putting them down... hard.
 
There's a lot of people who seem to live dribbling over headlines than dealing in reality in this thread.

For the 100th time - If I kill anyone, regardless of the situation I will be arrested.

It's standard police procedure. It gives me some rights and stops me running away and allows the police to investigate rather than just take my word for it.

It's nothing to do with SJW's and LGBT rights..

The guy hasn't been charged!
 
Someone got killed.
He should be arrested and case investigated but really only as a matter of procedure unless there are odd circumstances.

You shouldn't want to live in a country that allows manslaughter within the home by law.

He killed an armed intruder in self defence.

Questioned, yes. Arrested, no. Charged, absolutely not.

As I said above, only in lousy Britain...

So to take your idea further:

If I invite someone in, murder them and then smash a window and claim to the police it was self defence, I should get off scott free?
 
No.

The police can release you on police bail if there’s not enough evidence to charge you. You don’t have to pay to be released on police bail, but you’ll have to return to the station for further questioning when asked.

You can be released on conditional bail if the police charge you and think that you may:

  • commit another offence
  • fail to turn up at court
  • intimidate other witnesses
  • obstruct the course of justice
This means your freedom will be restricted in some way, eg they can impose a curfew on you if your offence was committed at night.
 
I am surprised the police have spared seemingly so many officers to this case, given the pressure on their time from other serious matters:
