Private car sale woes - 3 year update - car driven with no MOT

So the car does not have an MOT? does that not mean she can't get insurance for the car and also can't get car tax? So she is an uninsured driver, driving a car that's not fit to be on the road? I would inform the Police.

Lots of assumptions there. You don't have to have an MOT to get insurance, if the MOT ran out in November 2019 then it may have been taxed for 6 ort 12 months before then which would still be valid. Not having a current MOT doesn't necessarily invalidate insurance, it depends on the specific policy wording - some will state it must have a valid MOT, some may only state that the car must be roadworthy. A car can be roadworthy but not have a valid MOT, and conversely a car that is not roadworthy can hold a valid MOT certificate.
 
For some reason my MOT check on my car from last year added 100+ miles on despite it failing. I don't remember driving the car at all after it failed until it passed a week later after the repairs.

Mistakes happen, registrations get entered incorrectly, insurers processes fail and they don't do the MID update. You want to get it sorted ASAP though.

My mate had a hell of a time because another insurer entered details incorrectly, and long story short his reg was showing on MID as an uninsured Vectra. His car is an insured Civic!
 
Assuming you've not just renewed as i believe it can take a couple of weeks for insurers to update the database, it should be quite accurate!

If the car was out of your sight for a few hours and it's anything interesting the MOT tester may have taken it for a blast lol.

If a car fails it's MOT it can still be driven providing the last MOT Pass test is less than 12 months ago.

While an MOT failure does not revoke a previous MOT, if it has failed it's deemed as unroadworthy and should not be driven until faults have been rectified.

I know that used to be the case, but I also remember reading that a change had been proposed to prevent an unsafe car being allowed back on the road? It may have died at the consultation stage though.

I think it only applies if a fault is dangerous as @andy_mk3 has said. But an MOT tester doesn't have the authority to seize a car, only recommend you don't drive it.

It doesn't even need to be dangerous to be unroadworthy. But no, nobody can physically stop you taking your car and driving it away.

It's always been the same, nothing has changed, it's only recently been made clearer.
