Do I need a Structural Engineer ?

This is getting ridiculous amd unbelievable. Why would the police get involved in a civil matter!?

And why didn't you tell us that before?
 
I didn't know myself that he raised a police complaint.I came to know Only after police visited for an inquiry.

Supply a report from the Surveyor detailing the remedial works
Get a couple of quotes for the works

If they then refuse and you end up in legal issues you can prove that you offered to repair, you offered to mediate and the cost for the repairs is £X.

The court should only allocate your quote as the damages due and they should see any additional costs as theirs as you’ve done nothing but offer to repair. Courts don’t like people being intentionally difficult.

That is if everything you’ve said is everything
 
what does the other side of the gate look like? (that your neighbour will see all the time?) the 2 posts, gate and infill fence bit to the side are all different levels...

This is a good apprach but I'm still miffed op is gonna have to pay for a surveyor to insoevt when op still has seen no visual evidence of damage.

If you're referring to RICS mediators, do they work on hourly basis? I would otherwise guess they'll charge a flat charout call of £300-400 +.

Yes, This is a good approach but I assume the whole repair charge for 3 bricks itself would be within 300£(Max).So I am bit unsure about me paying for an independent Chartered Building Surveyor which would be a bit costly for me

This is basically succumbing to the neighbour's unreasonable demands though. A mediation with a chartered surveyor isn't exactly free, and if it really is just two nails put through two bricks, is completely unnecessary.

OP should continue to ask for access/evidence combined with an offer to remedy based on what he finds, and if that continues to be refused (and this is documented) then I think he remains on sturdy ground.

My favourite option offered above so far is having a mate go round in high vis though, so stupid that it would probably work.

The neighbour sounds like an incoherent end of a bell.

There will be no civil action resulting in anything bad for OP (unless he's withheld a lot of information).

The realistic worst case scenario is paying out for a professional's time on this.
 
I'd send the complainant a letter via recorded delivery outlining the attempts you've made to resolve the issue, including names of the building company etc and dates, describing how you've attempted to resolve this issue amicably and quickly, but due to unreasonable demands from the complainant you've been unable to reach agreement and are unable to take your repairs further. I'd finish the letter saying I've sent a copy of the letter to the builder and am keeping a copy in case the complainant decides to take legal action, as evidence of my willingness to provide a resolution.

Then just leave it. If he's left with unrepaired damage then so be it.

The email seems odd as well, so I get the impression the home owner isn't British either, and that they do not live there. This could be part of the issue, they have taken the right to privacy of tenants incorrectly since this is the sort of situation that would allow reasonable access given notice.

I mean obviously the damage need to be repaired, but thats a handyman job, nothing more.
