Interesting, so section 75 claims do usually result in a charge back to the merchant?
What about claims where only part of the payment was made by credit card?

yes my understanding was that I had to have tried to resolve the issue and have proof that I had done so, a mix of WhatsApp messages and emails proved he was simply ******* about then went silent.

I assume that on trying to contact the cowboy the CC company got nowhere and as such clawed the money back.

They refunded me instantly but did advise that if my claim provided to be fraudulent that the monies would be removed from my account
 
15 year old German faux 4x4. Catch 22 you need to be rich enough to afford a new German faux 4x4 to be able to afford the repairs on an old one, then you might as well get the new one.

Got a call from them today, after a twenty minute discussion we agreed on a reduced refund to £4.9k.

Did I want the full value? Of course, but did I want this dragging into the New Year, with chasing numerous legal proceedings etc? No, not really.

Excellent, you can name them soon then. £600 for selling you a dud, I get wanting it resolved, but screw that, they’d not get a penny from me.

Probably for the best. I’d have done the same. Arguably not worth the time, effort and hassle for £600. Glad it’s sorted without massive headaches.

Indeed, I know it's easy to say when you're not in the situation but the mental toll of it all was not worth the inevitable fight on my hands.

I don't doubt I'd have got all of the money back had I have a) pushed harder b) progressed further with the CC claim or c) gone via a MCOL.

It is what it is, on one hand I'm hugely annoyed by the whole situation, not least because I don't really think any of us have £600 to be throwing away for 8 days of car ownership, and because the dealership was - to my mind - clearly in the wrong.

On the other hand and as before I feel I've dodged a bullet and need to both put it behind me and learn from the mistake.

Completely understand just wanting to get it done and dusted but it's such a **** situation that being robbed of £600 is the "good" outcome.

That has been my mindset, too - I've gone back and forth between wanting to cause them a great deal of grief as they have done me.

But when it's been keeping me up at night and disrupting our Christmas period, I'm honestly just glad to be shot of it. I don't have to darken their doors again, and I've learned a fair bit from the whole ordeal.

I'm not without frustration but it isn't worth it from a personal perspective. Sure, if £600 put me and my partner on the breadline (and make no mistake, I know it would for a lot of folk), I'd have fought harder. Of course, if that were the case, I'd have not been buying an older X5 in the first place, either.

Lessons learnt, hopefully.

I've been debating how to deal with the whole situation - I'll sleep on it and consider it some more. I'll definitely be keeping an eye out for the car to appear on their site again.

This is likely going to come across as a poor decision but on the internet it's easy to say "take them to the cleaners", "leave them bad reviews", "see them in court", "**** in their letterbox", all both funny, tempting, and perhaps deserved, but back in the real world where you just want shot of it so you can sleep easier at night, I'd rather just forget that they exist and move on with my life, to me that sounds like a better start to the New Year.
 
I'm totally with your decision (except the battery) - however definitely rinse them with a fair and accurate review that is not libellous. If they contact you to remove it, ask for 600.

Fair perspective. Thanks for keeping me sane on here too, throughout - I genuinely thought I'd just have to keep the lemon indefinitely. I'm still convinced they're certain nothing is wrong with the vehicle.

And remember all the places too. Google, FB, autotrader etc. Don’t forget to mention the £600, I’d not deal with such a garage.

Without providing evidence in way of a review all you've done is passed the vehicle onto the next person they see coming.
What if some old doris buys it has the same bother you have with it and she plays friends even harder than you!?!?

Rinse them in the review, truthfully, ask them to return your battery and utilise the S75 claim for the £600 you've just had stolen from you.

I think you should leave an honest review, keep it short and honest.

Actions have consequences, if this dealer wants to basically treat you like this and basically screw you out of £600 by selling you a knackered car at Christmas, (because he has no right to take £600 from you). It's only balanced and fair that there is a cost associated with his behaviour, and a terrible review seems fair to me.
 
Keep your review concise, factual and all emotion and opinion out of it. Praise where necessary (if applicable) for example the loan car.

If your review stinks of butt hurt it'll be quickly overlooked by potential purchasers looking to give the benefit of the doubt.

Here's someone who's written a few bad reviews before :D .

But good advice, don't waffle on with how unhappy you were about the service. They sold you a car which broke down very soon after purchase, wouldn't let you return the car and charged you £1 per mileage for the usage you had since purchase.
