Chances of overturning driving ban?

I've driven for 14 years and I've never had as much as a single point on my license and I'm often very liberal with the right foot.

TBF, that's probably down to more luck than judgement :p

I've had points before but have had none for quite a while now. I spent a few years recently absolutely hooning around in my 350Z with not even a close call and since changing to my Mazda 6, that I now drive like a grandad, I've had 1 speed awareness course and 2 community speed letters!
 
I know she's your bird, but she speeds excessively and is caught with some degree of regularity over a relatively short period of time. I wouldn't say she's necessarily a dangerous driver, but it sounds like she is careless and has poor observation skills.

Disclaimer - I used to drive very, very fast on the road. Borderline racetrack stuff at times. I got caught speeding twice, in years and years (well over a decade) of doing this.
I’ve never been caught driving fast in my car, I have been caught multiple times in my van whilst mostly following the flow of traffic.

I had my speed awareness course so long ago I have that option back now (I believe)


I have no idea how I haven't had more than just that! I drove my s2000 "excitedly"
 
Full disclosure, I was caught doing 41 in a 30 about 8 years ago. Should have got points but instead I got offered the course. It was a road going from 30 to 40 (for about 100 meters) then to 60. I basically sped up to the 40 a touch too soon, was caught by a van as there is no fixed camera there.

The only other time I was almost caught by a van was when I must have been doing like a fraction over 40 at a 40mph road, I remember seeing the camera too late and then the officer made a motion with his hand like Ross in Friends doing the turn down the volume motion, to tell me to slow down a bit. I think the needle was at like 44mph which is a bit faster than my GPS so probably going at 42mph at the time.

Generally, I would drive to the speed limit on the road, if i am not in a road that i am familiar with i will have Waze open and follow that usually and then have the car pretty much at the speed that road is, or like 2mph under. But even then, need to pay attention to any changes that hasn't been updated, or roadworks that changes the speed of a section of the road, especially on the motorway with those average speed limit checks.
 
And then she got caught again.

I’ve had 9 points at once but I now have none. Learn or get burned.

Similar to me. Got 9 points in the space of 18 months. I was absolutely bricking it cos it could have been 12.

Made sure I kept my nose clean until the 6 points dropped off. Prior to this my license was clean for 10 yrs..

She never had a single point until around 3 years ago and she's been driving for almost 20 now. A lot of people I've talked to about it seem to have had similar experiences where they've had a 2 year period of just accruing points after a squeaky clean driving record for an age.

Mine was because I became complacent in not get caught for 10 years.

Still doesn’t take her personally responsibility out of the equation.

I hope she gets away with but I also thinks perhaps it’s for the best if she does get punished. Either way she is in the hands of the judge.
 
One thing that's also worth thinking about is even if she does get away with it, can she afford the insurance with 15 points declared? I imagine that, coupled with insurance going up for most people, it will not be cheap.

IMO anyone who gets this many points but pleads "my job" should only be allowed to drive for their job and no other reason.

Keeping licence in these conditions should come with the if your caught driving for anything than scheduled work here is your deferred jail time, x months.

Problem is that would be impossible to police. They can't even ensure that banned drivers don't get behind the wheel.

As everyone else has said OP maybe a short ban might change her driving behaviour - it's clearly needed. It's a privilege to be able to drive on the road, not a right.

The arguments we've had about it and the reality of a possible ban has hopefully done enough, but it is what it is and if ends up being a ban then we'll just have to try deal with it best we can.

As I said, it comes with a suspended jail sentence.
So IF you get caught you get immediately hauled up in front of a judge to get sent down.

Some may take the risk, but if you have a habit of getting caught speeding it would be quite ballsy ;)

I agree, ban, but if she gets off based on needing her licence that should only be allowed to be used for her job.

They count for 3 years for totting up purposes, stay on your license for a 4th year, but I believe you still have to declare all driving convictions to insurance for 5 years.

Play on your extreme hardship mitigation and hope that helps their decision, however she's most likely going to get a ban but my guess is it will be short.

Either way it's not like people who are banned are physically forced to stop driving - few trips here and there is no bother if necessary so don't let it fret you too much :)

Not sure the boys in blue would see it that way if they pulled us over :p
