Relationship question for a friend.

Hi,

I just wondered where my friend stands legally in this situation?

He’s 32 and she is 27, they have been dating for 3 months. He lives alone in a 3 bed house (Paying mortgage for 7 years) and she lives with her parents. She is now pregnant and wants to keep the child. The relationship isn’t go very well. So if the relationship was to break down completely, would she have any recourse to his house?

Relationships break down all the time and unless a couple are married neither party has any legal claim over the other's property. Having a child doesn't change that.

You'll (sorry, he'll) be responsible for child maintenance, details of which are easy enough to find online.

This should be the last thing on his mind but no, the house is his and that’s the end of it.

Now the priority should be the welfare of the child and ensuring it gets the best start possible despite the circumstances. As above, he will rightfully be liable for maintenance etc if it came to it but he should be doing what he can regardless.

Would she still have no entitlement if she was added to his council tax / paying bills?

Why would she be entitled to a property she hasn't paid towards?

She just lives there by the sounds of it.

She hasn't paid anything towards his house yet and she is still living with her parents. But if in the future she was to pay towards it, would her entitlement change?

That seems a really odd follow up question. Who is doing joint bills after 3 months?

Are you telling us everything?

well at least she will be able to move out of her parents now, She'll be eligible for social housing being a single mum with a child.

I dont know where he will stand legally or how much it matters but if he's in any doubt the child is his (I would if I'd only known the woman 3 months) he needs to read up on paternity test and perhaps not having his name on the birth certificate.
 
You've had your answer - she is not entitled to the house, he is only legally required to pay child maintenance.

It may need a grown up conversation between the 2 of them. Does she want to bring up a child on her own, especially if she is living with her parents? Or is this what she wanted? Got knocked up and straight onto the council housing list?
