Faulty ATI 4890 seller will replace with ATI 5770

Hi im after some advice so thanks in advance for any reply.

I bought a ATI Sappire Vapour-X in december 09 for £164.99 and over a month ago i sent it back which the card was found to be faulty.
Yesterday i had a phone call from the place i bought it from,(the place where Gibbo use to work),and they offered me a ATI 5770 Sappire Vapour-X in its replacement which i think is unfair as i cant find any benchmarks that say that card is equal or better than the card i had.
They also offered me a refund but would deduct a usage charge for the time ive had the card which would leave me with £104 to spend at there store.

so what do you think about that and what would you do.

A 5770 to replace a 4890 is a joke, they should be replace it with something at least as fast as a 4890. They should be replacing it with a 6850 I'd expecting providing they have no 5 series stock available.
 
The 5770 Vapor-X is noticeably slower than the 4890, so don't accept it.

Say you would like either a 5830, GTX 460 768mb or a 6850 (unlikely as its too 'new' ) as they are more inline with the 4980's performance.

but what if they wont agree,and then decide just to offer the £104 ? can they do that,or must they exchange for another card?
 
If they can't offer a like for like replacement, surely a refund is in order, and then you can buy something else?

If they won't accept this complain to the management until they do!
 
£104 for a hd 4890 is very reasonable, no? I sold a HD 4890 in MM for £50 just yesterday.

I would definitely not accept a HD 5770 though.
 
Can i ask what was wrong with it, mine has started to play up recently, getting problems running games (F1 / Fifa) Graphics getting garbled and green squares appearing. I've tried changing drivers ect, but to no avail.

Just wondered if yours was the same?

That's not really the point though, if there's a warranty then they should replace it with at least an equal product or greater in performance terms (with it being graphics cards). Warranties would be completely useless otherwise.

I think the SOGA says you can demand a repair or replacement. So the OP could keep pushing for a suitable replacement (and offer to take a full refund as a side offer), although it would almost certainly be in the best interest of the retailer to just give a 6850 rather than the cash.

The worst outcome would be where they manage to source a HD 4890 for you :p. I don't think it even has to be brand new either. Just the bare card alone will probably be fine. That's what Apple and other major manufacturers do when it comes to electronics.

This is what I think...suppose if they did replace the card with a different card for you (and there's no guarantee it is even a new card if it was a 4890), your warranty period won't be extended further I guess? If that is the case, and they have a good brand GTX460 768MB (i.e. MSI, Asus...not Palit) for sale at under £125, might as well take the £104 store credit and pay little extra and buy the GTX460 768MB and get 2/3 years of warranty?
 
£104 for a second hand 4890 is a good price but the point is im not selling it,its worth more than £104 to me.
this was the problem that the card had.

Another person from the same site has had problems,sounds like he wasnt even offered the same card,this is what his post said.

It has now been over a month since the card was returned to the manufacturer, so I thought I'd contact you again

So in short, I'm getting a refund of 159.71 + VAT for an item that I paid £270 for, and stopped working within the warranty period. Is this fair? I'm going to have to pay over £100 on top of your refund just to buy an equivalent graphics card
