This is not for me but a member of family i'm rather concerned about!. She has to go to job seekers on a weekly or two weekly basis however i feel in her condition she should not be working, she gets atleast one to two migrains a week which can cause some paralization and blindness in one eye. Well last month came as a shock as she was diagnosed with a PFO a hole in her heart, after having a bubble test and also in 2000 she suffered a stroke. At this current time she is at risk from a stroke until the heart op and also her pills she takes does have a habbit of turning into a zombie!.

From what she tells me she could not be signed off and the last time i saw her at the job center she was a shaking wreck and to me was unable remember certain things or understanding what i was saying. This was down to the medication!. What i do not want is her to be constantly pushed, worried and in a panic state thus an end result a stroke!. The amount of times she gets migrains just from laughing because of a blood rush to the head is enough for me :(

She also has two children which go to school and another in college with aspergers/autism.

Please OCUK no insults and i really don't want to hear anything about the worst that can happen with a hole in the heart as that is on my mind on a daily basis which is making me sick with worry!.
 
It would be unusual for a Dr not to issue a sick note if they perceived a risk to health of a patient through working.

If the Dr is fully aware of the condition and does not perceive it to warrant a sick note then there's not a huge deal you can do. Bar try another Dr.
 
Hmm... She doesn't exactly sound like somebody people would be highly interested in employing, as obviously no company will specifically want people who're ill or with conditions which could seriously effect working. Very strange that she is made to seek work like this, I definitely wouldn't be happy with a family member in that situation.
 
Doctors still do provide sick notes as my mate got one after slipping on ice and breaking bones in his wrist and hand.
The doctor wrote him one for at least six weeks as she said he was unable to drive and could'nt work
 
Remember you can always goto another doctor if you arent happy with your own.

My old doctor was a total nutter... i broke my wrist a couple of years back, it was a bad break and had to be splinted at an angle for 8 weeks. After 2 weeks i was able to do most things as the pain was managable and it was stable... however when the splint was removed the pain was excruciatingly bad, in fact it was even worse than the initial break!

The pain was due to the fact all my lower arm muscles had been doing nothing for 8 weeks and now even having my hand moved slightly caused pant wettingly bad pain. He refused to sign me off work for a week until it died down, as apparently i was just "malingering". The guy was a total jerk and he could plainly see just how much pain i was in from the cold sweats, the shaking and the fact i actually ****ed myself a little in the surgery when he "manipulated" the joint even when i told him it caused agony.

I moved doctors and reported him, as it happends he left there about a year later... maybe others had complained?

The new doctor saw me and couldnt believe how weak the painkillers i was on were, and was shocked to see that i had not been given the correct care as regards support and slings etc at both the hospital and my previous doctors.

All in all, if you are clearly being taken for a ride dont put up with it.

This isn't the first time the job center has been a pain in the arse, their attitude is disgusting. I can understand why they treat people who can't be bothered the things they come out with towards her :mad:
 
Get some proof from the doctors or find a new one if that doctor wont. She sure doe not sound like someone who should be stressing about work!!

Hope she gets it sorted one way or another.
 
Say to the Doctors that the JCP are requesting a sick note as she is clearly un-fit for work.

This is what my mother had to do with our doctors, and they wrote her one out on the spot and she changed her claim to ESA. Obviously this was for a different thing.
 
I don't see how she can be considered fit to work if signing on is even too much for her, she shouldn't be on Jobseekers in that condition.

Yeah exactly, I'd go to the Citizens Advice Bureau and see what benefits she will be eligible for because as far as I know JSA is only meant to be claimed if you are able to and are actively looking for work. :)
 
Speak to her, get an appointment with her G.P and offer to attend with her, she may not be conveying her condition or need for a med cert very well. Make it clear to the G.P that you require a med cert for the progression of an ESA claim. If they refuse to supply you one on medical grounds then ask their reasons but be aware that you will probably need to get a second opinion. If they claim they just aren't allowed then ask for that in writing and ask if they can direct you to the piece of legislation that codifies that. Also make sure the G.P is aware of the side effects of her medication and the impact it has on her day to day function.

She's eligible to put a claim in for ESA even if only for a short duration (until operation) however until the claim is accepted by a DWp decision maker the burden of proof is with the claimant. In practice this simply involves providing a med cert. She will then be contacted by the Departments medical services provider in order to arrange an assessment. However the benefit will already be in payment at assessment rate.

It would be inappropriate to comment on her probability to be found to have LCW however if you say she is at risk and is awaiting hospital in patient treatment then if you have any issues feel free to request that they consider the provision of exceptional circumstances, specifically reg 29(2)(b) in this instance.
 
What's most important here is the work she CAN do. For example I would guess she would be able to stuff envelopes between migranes, even when on medication. Maybe she could deliver catalogues to her neighbours - again in between headaches, but maybe not when on the medication. If she can do 8 hours of each per week then David Cameron will be a happy man.
