TV Licensing taking the old girl to court

Their stupidity never ceases to amaze me.

My mum has had a letter through telling her that the TV Licensing people are taking her to court. Naturally she does have a TV license and always has.

She has had numerous door visits where she has presented her license. She has had numerous calls where she has read out the license number or online reference number. They always say they will amend their records but they do not.

Any calls to them confirms she has a license yet they still pester her saying she does not have one. She has 17 letters for the TV licensing people telling her she needs a license (she has had many many more but she only started to save them after she realised this was going to be an issue).

She can produce 10 licenses including the current one dating back to 2004. Since 2004 she has paid online.

Naturally she intends to go Not Guilty however she has now reached the point where she would like to take them to court for damages - and also the day off work she needs to take to go to court. Will she be able to do this at this court case or will she have to take them to the small claims? How do you substantiate such damages?

****Update 14th Jan****

Mum filled out the paperwork and sent it back to the court, stated she would plead not guilty. Just waiting for the date now.

Icing on the cake is today she received another letter from them informing her that not having a license is an offence :rolleyes:

Added upset is that because she works for the police she has had to inform them that she is being taken to court.

Papers back from the court have a court date of 10th Feb.

Unfortunately the day after receiving the court date she received a one line letter from the TV Licensing people saying that they were dropping the case :(

Sounds like she could get an ASBO on the TV licensing folk too if she wanted. She should definately get some form of compensation from them for the trouble she's been through and the pain in the proverbial that the TV folk have been for so long. If about time they abolished this license and put it into the rest of the taxes or abolished the BBC if they were too scared to show it for what it is - a tax.
 
Is it an actual summons to court or one of their "we are taking you to court sometime soon!" letters they send out routinely?

TV Licencing is so poorly managed.
 
Surely by now your mum should have written them a letter saying that if they continue to waste her time then she will start billing them at £<random ammount> per incident?
 
Just sit back and let them make complete idiots of themselves by taking her to court. Then go to the National rags and kick up a stink about it.
 
I'm sure I read here on OcUK that no-one has ever been taken to court over a TV license? Or maybe it was that TV licensing have never won in court?

I can't imagine the TV License folk ever winning a court case. They have to prove that you have a plugged-in TV at your house. As soon as they send the court summons, anyone with half a brain would pack their TV away somewhere and say "But it's not been used since I moved in, guv".

Add to that stupid cases where they try to prosecute someone who actually HAS been paying their license...
