Do any of you remember an accident my brother had in my Saxo which involved hitting a drunk pedestrian?

Well, months down the line, its finally almost over.

After conferences with solicitors, statements with police etc, he pleaded guilty to dangerous driving (based on doing 30mph in foggy conditions, against what the highway code says). Although he broke no speed limits, he has been hit with DD, and pleaded guilty as per advice from solicitors.

With no previous convictions or driving records, we are hoping at very best for a Community Program, if not its a custodial sentence :(

Barristers are hopeful that his clean records, good Character References and personal statement (about the abuse he has encountered since the accident) will all attribute to the smallest possible sentence.

I have held back from updating because until last week when we went to Crown Court, we didn't know what was happening.

As the solicitor said yesterday, being honest gets you no where :(

I don't see how the pedestrian being drunk has any relevance whatsoever, I assume your brother lost control and mounted the curb. You can drive dangerously without speeding.

You assume wrong, from memory the drunkard had been arguing with some other chavs and was standing in the road.

i do, sober people generally stay on the pavment and are more cautious in crossing the road, drunk people walk on the road.

working at a club on the weekends the amount of people you have to drive round on the road is shocking and worse are the ones that actively walk into your path
 
With car/pedestrian accidents the pedestrian is generally at fault in around 70% of them, and in half of those drunk. Yet it is the car driver that nearly always gets the penalties.

Why do you feel the need make incorrect assumptions when a simple search would have revealed the orginal post?
 
Hope your brother gets off lightly, from the sound of things this is another case of the motorist being punished for something that is definitely not entirely his own fault.
 
If it happened like you said I really don't think he should face a custodial sentence. Maybe if he was speeding excessively or was drinking himself but not like this.

I am sorry about the pedestrians death but it sometimes things just happen, horrible thought but it sometimes just happens.

I hope your brother doesn't get punished too hard for this and it is over with quikely. Then he can get on with the rest of his life.
 
Pedestrian didn't die, infact a week later he was back in to his routine of going out on the drink again.

He was in the road arguing, in thick fog my brother saw him, swerved out of the way but unfortunatly he jumped in the wrong direction.

He didnt mount the kerb, nor was he speeding. As the judge described at the plea... "a tragic accident" :(
 
Bloody typical, I know how your brother feels to a certain extent. I was wrongly convicted for an accident that wasn't my fault, under the stereotype that I was a young driver so must have been at fault :rolleyes:

When does he get sentenced? Best of luck to him.
 
Its in the first week of December. I'll be there to support him, he puts on a brave face but i know he is VERY nervous.

You have obviously never been out driving in or near prity much any town centre in the UK and a Saturday night. There are drunks staggering and falling into the roads everyware.

If you ask me the drunk got what he deserved. Maybe he will think twice about randomly strolling into the road while hammered in future.

If you drive near any school at about 3:30 Monday to Friday you find numerous 15 year old chavs trying to take on cars while perfectly sober. It’s more of a case of “I’m hard as nails you WILL stop for me as I strut over the road as slow as possible”.
 
Wish him all the best mate, there is no way i would have pleaded guilty myself. I would have argued to the end.

Was it in town? They are idiots for it, i had some lad walk right out in front of me outside Woolworths just last week, late at night and by the look of him he was drunk and angry. Just stormed out in front of me. Hit the brakes, window down and shouted abuse at him.

Is your bro still driving around in a blue saxo?
 
For a few years I used to drive home at 11pm and come friday and saturday there was always someone walking down the road or in the road waiting to be run over. I often used to take the longer route just to avoid this kind of thing happening
