The UK High Court found in October that HTC had infringed Nokia's European patent number 0998024, described as a 'modular structure for a transmitter and a mobile station'. As a result, Judge Richard Arnold ruled today that HTC can no longer sell its One Mini smartphone in the UK.

HTC had tried to argue that the microchips found to infringe Nokia's patent were “a very small component” and therefore did not justify a sales ban. It also claimed that HTC does not compete with Nokia in the UK, because its smartphones run Google's Android operating system while Nokia's running Microsoft's Windows Phone OS.

However, Nokia dismissed these arguments, claiming that it has "lost sales of Lumia phones since the launch of the One range." HTC sold about 715,000 smartphones worth about £221 million in the UK between January and September, according to court documents.

HTC's flagship One smartphone was also found to infringe the patent, but a ban has been delayed to give HTC time to appeal. Judge Arnold said in his ruling that blocking UK sales of the One would cause “considerable” damage to HTC's UK business.

HTC has until 16.00 GMT on 6 December to apply to the Court of Appeal for permission to appeal against Justice Arnold's ruling. The company told the Telegraph that it had already filed urgent application to appeal.

"Pending the appeal, HTC has undertaken not to ship any more of the infringing products into the UK, except the HTC One which it may continue to sell until the conclusion of any appeal," said Nokia. "If HTC does not succeed on appeal, the injunction will take effect on all infringing products. Nokia is also claiming financial compensation for the infringement of this patent."

Nokia sued Apple over the same patent and settled the case in April 2011, after agreeing to grant Apple a license.
Sorry if this has already been posted. This would be a huge blow for HTC? Especially if they also lose the main HTC One phone aswell.

Bit worrying as HTC One owner, would be a shame to see a lack of support for this phone in the future.
 
tbh the whole patents wars is getting out of hand


we have patents on pretty generic features for modern phones and companies are playing a tit for tat game now with the patents
 
They are still for sale in places like CPW but from that it looks like once stock is gone that's it. Was looking at getting my son one for christmas but I'm worried about a lack of support for the mini as they're quite new.

As I posted in the last thread in question (And your Telegraph link states), they were *only* 'banned' if HTC failed to file an appeal by the 6th ;)

This is one of those which will go back and forth until long after they're obsolete :)

This does not sound like good news to me.

Presumably HTC could come to some sort of a licensing agreement with Nokia, as Apple did, but is that likely, I wonder.

If not, and the ban was made permanent... if that were possible, then it could adversely affect the resale value of the HTC One, I would have thought.
 
Just another example of an Android vendor cutting corners and not paying proper royalties ;)

In all seriousness though, the phones are either close to being discontinued, so HTC wont bother, or they will appeal and/or get a license for the patents in question and the ban will be lifted pretty quickly.
Impact will be minimal.
 
Nokia could go after Apple and everyone else with the same EU patent. It applies to Qualcomm/broadcom modems, for which theres an agreement between the two in other markets. The notes make interesting reading.

Nokia are just trolling HTC hard atm.

This. Surely it's more of Qualcomm's fault? Either way this is getting silly, all these patent wars and banning products...
 
No idea, all these settlements are confidential and Qualcomm/broadcom want to protect chip designs, even from OEMS like HTC apparently. It's all a bit messed up as nobody knows who's paying who for what and should they be paying any money at all? :D

Nokia also admitted LG and Sony are too small to bring to court, with extra MS cash they might have a go soon.
