Right, I took out a 12 month contract in September last year with 02. Came to my year up and I just carried on as normal, mainly because I hadn't had time to phone up for an upgrade and because I was happy with my K800i.

Anyway, this Sunday the phone just stops sending and recieving texts. Constant error messages "sending failed" with the option to retry etc. It could make calls fine.

Phoned 02 up on Monday and explained, they said it was the SIM and they'd send a new one out. In the meantime i'd got an old 3310 and whacked the SIM in there. It worked fine. Could text, call no probs. I rang 02 and said that I thought it might actually be the phone as I had the SIM working in another phone fine. The guy on the other end said as my contract was over 12 months I couldn't get my phone repaired or a new one sent out unless I upgraded (and my monthly bill) at the same time. I only spend £25 a month so £40 is too much for me.

Well, the SIM arrived and I got it activated etc and all was working fine until again, no texts.

What to do? 02 don't really want to know and all this time i'm left with no way to text?

well if it is working in another phone then you are prob right in assuming the phone is at fault.

They are right as your contract was 12 months that is the same for your phone warranty.

If you do not wish to change your current monthly rental level to £40 but do not mind going into another 12 months contract just upgrade in an O2 store.

Tell them you want to upgrade/renew your contract want a new phone but do not wish to change your tariff (it will just be scanned thru as a legacy deal on 12 months using your band level).

Depending on your band level they will advise which phones you can get for free and the ones you would have to pay for.

Sony Ericsson handsets carry a 24 month warrenty. You should still be entitled to a repair. If you want proof, check the documentation with the phone or give SE CS a call.
