02 return help

i bought a LG KU990 Viewty payg on the 17/7/09 for £127 from a 02 store, its not a bad phone and theres nothing wrong with it but my bro has just got a nokia 5800 and i really like that one so my bro said he would take it back for me as you get 14days for returns, anyway hes just phoned me to say they can only offer an exchange because when i got the phone they give me a £5 free upgrade topup because ive been with 02 for a number of years. now the sales guy didnt metion anything about not having a refund if i get the £5 upgrade. any ideas on what i could do

Quote the Distance Selling Regulations (DSR) to them and say that you are sending it back - if there's an issue ask to see a supervisor as you might have been missold

i bought it from a store in town so would the DSR still stand? also it was sold as a "viewity light" so i asked what it ment and the sales guy said you didnt get so stuff in the box, now when i got home all was in was the phone,manual and charger now the was no pc cable which kind of anoyyed me, the sales guy didnt say anything about that
