3570k on asus extreme4 gen 3 not oc'ing

hey guys until today i had an i5 2500k running at 4.6ghz on the mobo in the title, i switched it out for a 3570k i got from a friend, updated my mobo bios to allow me to run the new cpu however now i cannot over clock it. it wont let me change the multiplier any higher than 38 ive been messing in the bios now for the last few hours and not managed to solve it, even tried the asrock tuner from the os but still wont let me go any higher than 38x any help is great thanks as it was running at 4.4ghz in my friends pc until he took it out sunday.
 
tried the cmos reset button on the back of the mobo but doesnt seem to clear it, says defaults have been loaded but then when i check the bios all my settings are saved
 
Thanks. I was looking for a CMOS jumper on the board to suggest you try that method, before removing the battery. However, within the instructions for the jumper method on Page 37 of the manual, it says:

Please be noted that the password, date, time, user default pro le, 1394 GUID and MAC address will be cleared only if the CMOS battery is removed.

So you might as well just go ahead and remove the battery.
 
heart in mouth moment then! found beta drivers on the site so thought i would give them a go... half way through the bios update we had a power surge which shut off the pc. wouldnt boot back up just kept power cycling! after fiddling around got it to boot and reflash the beta bios and now its stable and i can oc again.
