360 problems - To much to ignore?

Ok people, most of you know my stance on Microsoft as of my personal experiences with them. My fourth has borked and i'm waiting with baited breath the return of my 'fixed' console. Firstly, after the latest rumours (which seem to be correct) it seems that 1/3 of 360's are turning out to be faulty. So for one, is this legal? 1 in 3 could be deemed as 'inherently faulty' and therefore not fit for sale at all. But more importantly it seems these problems with disc read errors are more worrying. Two games, more than any other are causing problems - Gears Of War and Forza 2. For me, I played my brand new Forza 2 for not half an hour before i got a DRE, I have never had this problem with any other game except for Gears Of War. Now, searching many forums, google etc... It's more than obvious that many many other people are having DRE's with GOW and F2. What does this mean? The 360 has problems reading discs manufactured by MS (I need advice here, are ALL games manu'd by them?) or is it that their manufactuiring plant is churning out faulty discs? I find it more than a coincidence that only a few certain titles get DRE's constantly... Now taking into consideration that either -

1) Your console is faulty it's scratching discs and they should replace your games under warranty.
2) Your disc is faulty and should be replaced under warranty.

So why then are they charging to get games replaced? Also why are they only replacing certain games? Because they know they may be faulty or because they are the only one's manufactured directly by them? In either case, they are admitting a fault and making US pay for it, the legality of this is what?

Please excuse me for ranting but I am genuinely concerned that they (MS) are aware of problems which they are (as far as the law and warranties go) breaking all the rules and probably the law.

One more thing, if this was Sony, most of you would be screaming for their blood, has it got to such a point where MS have almost monopolised the market and nobody cares as long as they get to play (when they work) their games?

Opinions please, no stupid fanboyism please.
 
Microsoft must be aware of the situation regarding dodgy xboxes as they've issued hardware cooling revisions for whenever they go in for repair and new boxes.

As for the CD scratching thing, again, I'd say yeah they do know about it. They recently signed up LG (IIRC) to make the new drives for the consoles, so who knows, they might fix the problems.
 
But it seems more than odd that Gears Of War and Forza 2 are the two most common for DRE's and scratching.
 
The only problem with DRE I've had is with Oblivion! Everything else has been fine, but oblivion is annoying, sometimes it will be fine for hours other times it will do it every 15-30 mins.
 
My 360 is off with MS at the moment after disc read/scratching problems and I have a Forza 2 disc with a big scratch on it. The 360 has also scratched my GoW disc but at least that still works. Forza 2 will be going back to blockbuster to be replaced as soon as the flood waters subside and it reopens. Not going to say the 360 scratched it, just going to say it's stopped working.

One thing about schemes like the disc replacement program - they don't affect your statuatory rights, just like the 360 warranty doesn't either. You're entitled to these things working and you're entitled to have the retailer cover the cost of repair should they break. Your rights to sue only end 6 years after buying something, and the law states everything should last 'a reasonable time'. That's going to be 3 yrs or more for a games console and probably a similar time for a game disc.

Btw yes it's only Microsoft published games which are on the replacement program.

So surely that means we sould be getting free replacement discs? Meh...it's only a tenner and tbh i may well have move the 360 while the game was still in there, i just cant remember...

Mine is at MS now as it scratched my Forza 2 disc, and I know 100% I NEVER moved the console at all, it never even left the machine, so its a fault.

Fortunetly a hard rub revived my forza disc, but my 360 has gone back regardless, cos it will scratch all the way next time.

And they think I am going to pay to get another copy of a game I only bought a few weeks ago cos of their faulty machine, over my dead body! I would bug anf bug them until they realise that it is their fault my disc got scratched in the first place! I agree with JBeck, this cannot be legal surely?

Well sorta, I mean you didn't buy the games from Microsoft so it's not their legal responsibility should they break (if they just break on their own through poor manufacturing). It is their console that scratched them though, but again you didn't buy the 360 from Microsoft you bought it from a 3rd party retailer. You probably have no legal rights against Microsoft at all (except if they break their specific warranty promises) since you never had a contract with them, the rights you have are all against the retailer.

Even if we're talking rights against the retailer, it's not really a case of they should be doing this or should be doing that. The law doesn't say they have to do anything, just that you can sue them to get back repair costs. The law gives you that right to sue them, but it doesn't say they have to go out of their way to fix these problems off their own backs.

If, like most people, you're not willing to put up with the effort of going to the small claims court, there isn't much you can do really. All I can suggest is speak to trading standards and maybe complain to the BBCs Watchdog program.
