3G Netflix issues

Alright folks, sorry if this has already been asked but i did do a quick search and found nothing.

I and a couple of friends have the iPhone app and since realease date those of us who are on Orange and O2 have nothing but constant issues with streaming while connected to 3G.
Can log into the app fine but when clicking on any video it brings up the following error:

'A problem occurred while playing this item. Try again later, or select a different item. Go to www.netflix.com/support for more information. (139)'

Now, i 'tried' to speak to Orange but got absolutely no where, colleague tried speaking to O2 again and nothing.
Called Netflix and they again stated they had no issues at all, the lovely lady did however state that it wouldn't stream unless it detected a constant connection of 1.3Mb or above. This does seem like the only valid explanation as doing speed tests jumps between 0.3 and 1.9 on my phone, although my O2 colleagues who have the same issue are pulling in a connection of over 3.0 and still have the same error.
The colleague on Three has no issues at all.

Im wanting to know if anyone else has any ideas or any issues of their own as i cannot find information about this anywhere.

Edit - To note, if i connect to a US VPN connection on my phone i can start a stream going without any issues, even if i then leave Netflix open and close the tunnel i can continue streaming the rest of my video on my own connection without any issues.
It just seems to be the initial loading of the video that gets refused.
