Yes you can, as long as the card is not modified or damaged in any way I can sort out a return

Sorry to be a pain but is there a date limit from when you bought the card? I bought it on the 14th November.
Update the first post with gibbo's updated reply how this is being handled by ocuk. If you start a thread atleast have the decency to keep it up to date.
and all the NVidia fans are slating the 290x thermal output - becauswe 100watts is so much more isn't it, oh wait 3rd party coolers sorted that

I just got my RMA number, but it says it says the desired action of the RMA is to replace, which is pointless as one 970 is going to be the same as the next when it comes to this issue. I will get on to customer services
I returned my 2x 970's yesterday, to be fair I did come away with 2x 980's.

thermal output =! running temperature.
if the thermal output is 200w, then it'll be 200w whether it's water cooled or or passive.
ie, 290x will still dump a truck load more heat in to a case and if you dont believe me, go sit next to a 100w lightbulb for 10 minutes - they the extra heat being dumped by a 290x on top of a 970.
