9800gtx only shows up as shader model 3.0

my new 9800gtx+ shows up as only shader model 3.0, though it is supposed to have shader model 4.0 support
it says SM 3.0 on systemrequiremnts lab (can you run it) and i don't know whther i need vista to have SM 4.0?
please help as i'm quite new to this stuff
