I am aware of the dual boot problem which can be fixed with a beta bios, but if i boot from cd/dvd and change it in bios accordingley, if i change it back to boot from HDD its still looking ofr the CD/DVD and fails to boot.

The only way i can resolve this is by resetting the bios.

yes i am pressing F10 to save my settings.

Was a fresh install and i had two hdd's, 1 x 200gb sata & 1 x 500gb WD.

Well i installed the latest bios and rebooted and got the cd not read error so cleared the cmos and now wont even boot, the red lights on but nothing no fans noting at all..

Think the bios is borked, tried just about everything so put my old board back in and im working fine.

Got to say never had a poor quality mobo like that not impressed.

NB heat sink was not straight and tilted to one side (not flat).
Memory slots very very flimsy, though the memory sticks was going to fall out.
Only half the mobo has solid state caps.

Very dissapointed coming from a rock solid 1 yr older board.

if necessary you can get another BIOS chip as it's socketed.
The initial error sounds as if the OS install had managed to install some boot files onto another drive which is why I asked if there was more than 1 installed at the time.

Memory slots very very flimsy, though the memory sticks was going to fall out.
never seen that, they are afaik the same as used by other manufacturers (there can only be a few oems for them)
Only half the mobo has solid state caps.
so what?
it's not meant to be 100% solid caps & they are largely for marketing - they have no effect on performance compared to equivalently specified "wet" .

Regardless of the fault it was a poorly put togeather piece of equipment.

The heat sink for the northbridge wasn't even flat, so wasn't making a good contact.

I wasn't happy you will defend Abit regardless :)

if I'm right it's a second hand mobo - for all that I know maybe the original owner changed the TIM or perhaps it was transit damage?

& no, I won't defend abit (or any other company) regardless but as yet another piece of research recently confirmed/showed something like 95% of "faulty" returns have nothing wrong with them.
