Accident 3rd party accepting liability

So was involved in a RTA , I got t boned at a junction at low speed.

Other party accepted liability and offered me an amount as my car is 12 years old and deemed "Uneconomic to repair" offered £800 for it , the amount isn't enough for me to buy anything I'd want and they've offered me a hire car for 7 days or an incentive of £70 for not having a hire car !

Initially I thought the offer was fair, but i didn't I take into account what I've paid to keep it in good shape and then the fact I've no car anymore I feel its not.

I've spent £1100 over the course of last year to keep my car in good condition and had the following work done on it "Cambelt/aux belts/water pump,Suspension brushes,Tyres,New brakes Discs/pads all round,exhaust"

Their insurance is keen to settle quickly, Would I be stupid to accept this without an argument ?

My car is a "Small Coupe made at the end of the 90s though to early 00s and made by the big blue oval firm. It was in very good condition and had FSH.

How would you guys proceed with this/what are your thoughts ?

cant think of any others.

Decline the offer saying you want to replace like for like and hope for a better offer.
 
Probably have a sore neck right? Add a grand on to whatever car budget you want to end up with :p

List the work you've had done that you feel is important to a puma

See if you can find adverts for pumas with that work done in the budget they allow

If its not possible go back and tell them. They've got to put you back in the position you were in

I've talked to their insurer and said i wasn't injured and don't really want to lie tbh, i can see why people do.

I just don't feel like I can justify being out of pocket which i will be.

I might attempt to have a honest conversation with them and advise i could go down the route of appointing a help-hire type company and insist on getting a 3 door coupe loan car from them.

Also that I'll be out of pocket for the next x years as my premiums will increase and I could have medical issue that have not yet appeared.

With the above in mind £870 is a little low, I don't want to get screwed,

So basically I have to be an arse about it all to get anywhere ? :confused:
 
Yes. The person on the phone is employed to screw you over for every last penny, sadly. I'm not being a drama queen, its that its in their employers interest to spend as little as possible
 
The first offer is most likely based on trade value, if you send them some evidence ie. autotrader links and adverts for similar cars that are more they should up the value a little.

Sadly insurers are only obliged to credit you so you can buy a similar car. They ignore work you have just had done on the car. As I have just found out, one month before a neighbour wrote mine off I had all four wheels re conditioned and two new pirellis.

This is why I can see people make false claims, (I didnt and I was not even in my car). The guy that hit me accepted blame and paid his excess, that was it for him. Where as I am still waiting for my money over a month on from the claim and have had to battle to get a value near acceptable. Overall I am down the £400 for the work I had done and some more as the car was worth more than the final value.

If the damage is CAT D and it was only a banger with some body work damage, you could buy it back for peanuts and use some of the money to repair it your self and drive it till you can afford something better.

Either way it is all a massive headache. :)

Anyway, you're entitled to be put back in the position you were before the crash, so you'd expect any recent work to the car to be taken into account. I'd just changed the head on my ZS diesel, and got another £200 on the claim for it (did the work myself).

Unfortunately market value will play a factor - find examples on eBay and Autotrader on similar age/mileage and then factor in a little extra for work done.
 
The point of the pay out is that you go and purchase the same car of equal quality and value.

If you can't, tell them to repair it or source you the same car of quality.

My 330d Touring with 150k that was uber high spec was worth all of like £4500, yet they paid something like £4000 repair costs from BMW for a new tailgate etc. So I'm not sure, I was fully expecting a write off. It was rear ended whilst sat at the lights.

Argue with them then!

My Fabia vRS was written off in October. The first offer I got was £3200. I ended up getting £4500 after two days negotiating. After I rejected their second offer they asked me to send adverts for cars of similar mileage and condition. The trick with these is to find ones that match your car as closely as possible, and aren't overpriced.

You can get loads of cars that aren't sheds for less than £1200, one of the few things that's good about Britain :p

Were you after another car of the same make / model, or open to others?

Plus, your insurance company aren't going to care about you discussing the issue on forums. :)
 
yes and

maybe. if the car was £500 worth, but was utterly decimated (££££s to repair) then it would not be reasonable to insist they repair it

if its going to cost you hugely over the odds to get a equivalent replacemment, then yes, they should repair it

How long ago was your accident? I ask because on 20th of jan I had a minor accident on an icy road, no particularly harsh impacts involved. At the time I had the most minor of twinges in my neck, a very slight discomfort that I didn't notice unless I thought about it and even then not much

now just over 2 weeks later its only just starting to hurt, same discomfort and slightly twisted feeling (looking forward i experience more discomfort that looking slightly to the right if that makes sense, feels like my necks default position has been twisted around) but magnified enough to give me pain most of the time and trouble sleeping

In my case there was no one else involved and I didn't take personal injury cover because frankly I never expected to be the cause of an accident, even in this case it was an evening of severe weather warnings and I drive a rwd car, left to my own decisions I would not have embarked on the trip but I was required to for work, so in short I cant claim for it anyway

Im just suggesting however that if you only just had your accident it might be too soon to tell, you shouldn't immediately brush it off and declare your fine

Sorry, at this point I just want fair market value for my motor.
I've agreed a price which isn't far off Glasses top value for it, so that's good.
Not looking at older cars tbh,

I'd have liked to replaced it was another Puma but, decent nick ones are hard to find and they are getting on a bit now.
I've run one for 3+ years now and love it, but need something bigger and newer.
More than likely banking the cash and saving for something newer, of using it as a deposit.

Accident was 8 day's ago, first 12 hours felt fine, worked through a night shift that evening/next morning and it started with neck and lumber pain. Couldn't sleep more than 3 hours because of the pain/discomfort of it.

Neck/lumber pain lasted about another 12 hours, it then seems to now have moved down my back to my lower back :(
Neck and lumber seem ok now, although still tender.

I've had 6 days of moderate lower back pain and discomfort from it and on average 4.5 hours sleep, for the first 3 days I felt a bit drunk and not really co-ordinated, I felt like a old Zombie basically and am still in pain.

I told their insurers about the neck/lumber pain on the 2nd day, they offered me the shut up and go away and never mention it again amount of £650.

I advised them I want to see how it goes over the next few days, and I'm glad I did.

I didn't go to A&E as I hate the place and the usual 4 hours wait would have annoyed me. I did go to the Doctors yesterday, and he advised he thinks its no more than muscular pain. Advised me to keep moving (but not to put too much weight on it when I asked about re and to keep taking Paracetamol and Ibuprofen and come back in 2-3 weeks if it gets no better or earlier if it gets worse.

They've been hounding me to settle, but they've not mentioned the Personal injury claim since friday !

The other annoying thing about it all is I can't really take any time off work, I work Nights in a small team and would loose overtime and bonuses that pays my mortgage.

I'm without a car, as I'm probably going down the route of getting the extra incentive they offered to not have a hire car, as it brings the amount up to about what the car is worth.

My insurance will rise 10% over the next 5 years on average, due a none fault claim, yet they won't offer anything to compensate this cost.

All fun really !
