Alright, had abit of a bump today.

I went down a road and there were road work's blocking my way. So i reverse to turn around, going back the way i came as i couldnt do the 3 point turn.

As im reversing for a couple of meters, past and unmarked junction, a man turns left and pulls out, and so we make contact.

Its his fault isnt it? As its a junction and he should be looking before he leaves the junction.

Hes the grey one, and im the red one. He came into my path as i was reversing. There were parked cars about too.
 
Which is the front, which is the back of your car?

To me, it looks entirely his fault as although you were on the wrong side of the road you still have R-o-W...

Depends on the type of impact, was you both moving when you hit?

Or did you spot him, stop, and then he hit you?

He probably pulled out because he wasn't expecting anybody to be that side of his car when there is roadworks there.

Although you're right in saying he should look both ways before pulling out, you should also be fully aware of what's going on around you when reversing. He may of pulled out infront of you and realised his mistake, but you didn't see him either and you both hit. It's hard to say who's in the wrong without seeing the accident.

Why couldn't you do a 3 point turn? It sounds like that would have been much easier than reversing back down the road. Or use that junction to turn around in?
 
@ci_newman: The start of the red arrow of the red car (my car) is the rear of my car.

@iCraig: It was a low speed impact. I was reversing down the road a few metersi didnt steer into the junction so he must have pulled out fast. I was looking through my rear window then i turn see him and smash, he drove into me while i was reversing.
 
Why were you reversing on the wrong side of the road? Were there roadworks on the left?

Personally I'd say its still his fault for not looking as he pulled out of the junction. If he pulled out on you he could well have pulled out on a car or bike going the right way.
 
If you reversed into him, you're likely screwed.
If he has hit the side of your car, then you could be alright.
Either way, the fact that you're reversing down a road, opposite a junction, really isn't in your favour.

Don't admit fault to anyone, let your insurers work it out.
 
I'm not sure I follow something here - you were actually on the left side of the road weren't you? If you were simply reversing back down the road without turning anywhere at that point, then he couldn't hit you without going over to the wrong side of the road and would be firmly in the wrong.

Ah, clearer now. Yeah, think you're probably in the wrong to be honest.
 
I think you must accept some of the blame - reversing past a junction is not really a good idea. However, he should have looked both ways before emerging. It'll probably end up as a split settlement depending on witnesses and the will of your insurers to contest it.
 
assuming no-one wants to claim for any personal injury or loss of earnings or anything (for the period whilst the cars are being repaired, should you be dependant on the vehicle for work purposes etc) then a split settlement would probably be you are just responsible for having your own car repaired. not sure how it would affect any no claims you have built up though... and since you have gone through the insurance it will probably still be recorded that you've been in an accident, though a 'non-fault' one at that. to be honest i wouldnt suggest anything, just let your insurance deal with it and see what the outcome is.
 
This could be a tricky one as it is an UNMARKED junction, so there are no road markings depicting who has right of way. It could possibly be put down to shared responsibility but hey maybe not, I ain't no expert.

CHOPPER - I don't know what you're up to but can you please contribute to the boards sensibly. Bumping threads which are now well and truly done and dusted really doesn't achieve anything.
