Accused of bumping another car when parking.

Really fuming at the moment! Me and my partner were driving to collect the kids from school and parking there was very little space, so we had to park close the the rear bumper of the car infront. The car infront had room to leave. A moment after we noticed tgere was someone inside. They claimed we were touching there bumber. The other driver got out the car wiped the rear bunber said your lucky. We at this point reversed back alittle. He then got out and then said we had caused a stone chip. However if i ve made contact my registeration plate would have touched which is smooth and not possible to cause this damage. Next he partner who is in the car infront claims her phone fell outa of her hand. We both drove off. We both took down registration platess but no details. Surely the other passenger cannot count as a witness. Where do we stand on this ?

It wouldn't surprise me if a claim comes through against you in a couple of months from injurylawyers4u. The best (legal) thing you can do really is hope they don't bother.
 
I think that witnesses must be impartial.
If a medical professional gives a diagnosis of whiplash from a bump at parking speeds (<5mph) they should be hung, drawn and quartered.
 
Worst case - the police phone you up and you explain your side of things. The police call the other person and say they're not gonna prosecute you. Your insurance details might get handed over, but it'll never be actionable.

They will just say the OP ran into the back of them 'so hard I dropped my phone!!!!111'

I'm not sure what the OP could be prosecuted for in this scenario even if he ploughed into them at 30mph.
 
I thought witnesses don't count if they are in the same vehicle?

If your insurance is notified, be honest and tell them you suspect skullduggery. They seem to be hot on insurance fraud.
 
I had something similar to this in supposedly "hitting" someone elses car a few years ago. I was crawling at about 3mph to a stop behind another car at a set of lights, had 3 mates in the car who were messing about, so admit wasn't fully concentrating, but stopped within about 2 inch of the other cars bumper, my car being a Seat Leon and the other being a 4x4. The woman got out claiming i'd hit her even tho we hadn't touched, one of my mates got out took pics of both cars to show there was no damage, she took my reg and i took hers and thought nothing of it.

A few days later i got a letter from my insurance saying a damage and whiplash claim was being made, i disputed it and sent the photos and a witness statement from one one my mates. She was on her own, she said her bumper was cracked and wasn't before, there was no damage to mine but my witness didn't count and she won the claim. So i lost 2 years no claims, and a good chunk on top of my insurance.

So no way the damage can be caused by the smooth plastic on my plate. When we edges forward we were barely moving both me and my partner both felt nothing.

Proc it sounds like your case was very unfortunate was there was witnesses her side to say you bumped the other car.

This is just a clear sign of the times we live in today
 
I had a taxi driver get out and say I hit his rear end...I was sure I hadn't but you get put on the spot and start thinking maybe I did.

I just kept calm and said I didn't through my window, as he dived out his car like rambo doing the "wipe the dirt off the bumper" I just said whatever and drove off.
 
No she was on her own, so whether they took women on her own over car with 4 lads in who knows. But yeah unfortunately its all too common these days, but hopefully the new rules regarding whiplash & false claims will put an end to a lot of it. Hope you get it sorted out.

The more i read about stuff like this the more it outweights the hassle of getting one and installing it. All of these instances could have been resolved if these were more widely used :(
 
I would personally inform the police of the situation and leave it at that - if it comes to something at least you've given your side of the story before them, and hopefully they'll get punished for being lying ********* who don't deserve the air they breathe.

There is no need to inform the police.

They only need to be informed if a crime has been committed or somebody is injured at the scene.

Unless the OP is still outside the school discussing said incident with the victim still complaining of pain, the police won't and don't need to, get involved.

Has the claiminant got any independent witnesses ?

Without them, and without any actual damage, she won't have a leg to stand on.
 
i had someone bump the back of my car while parking, i was sat playing with my phone and i felt an ever so slight bump, looked up and saw someone looking at me in the mirror. they then reversed a bit, got out and went about their shopping.

I wasn't really fussed as i got out and had a look....maybe the tiniest of scratches. not worth bothering about. but would have been nice of them to say sorry xD

my ex used to say that's the point of the bumpers to help with parking :p oh dear!

but yea I hope nothing comes of this in your case, if they put in a claim they are pretty petty! ZOMG whiplash from nothing...

and the phone being knocked out of her hand? was she balancing it on her finger tips? i say she;s just a clumsy b**** :)

good luck :D but yea definitely stress the point that you were really careful, felt no resistance/impact, cars weren't touching when you left the vehicles. and say they are full of s***
