Agency Holiday Pay

Been working for an agency, first payslip and they have kept some money to be used for a holiday fund.

I'd rather just have the money, can this holiday accrument be refused?

I can pick when I want to work, so it seems very pointless to me, if I want a day off, I'll just have a day off lol
 
Entitlement to payment for leave accrues in proportion to the
amount of time worked continuously by Temporary Worker on
Assignment during the leave year. The amount of the payment to
which Temporary Worker is entitled in respect of paid annual leave
is calculated in accordance with, and in proportion to, the number
of hours which s/he works on an Assignment. Any payments for
leave will be calculated on the basis of rates paid during Client’s
normal working hours (ie not including overtime). Payment will be
at the rate of 12.07% of the hourly or daily rate and will be paid at
the end of each quarter.

Presuming if I don't take it I get it paid back at the end of the quarter then?

never been on a contract like this before lol
 
That sounds like it's based on a zero hour contract of employment, where you get paid 12.07% (which is the equivalent of the 5.6 week's holiday entitlement that normal employees get) of the hours you actually work as your holiday entitlement. I tot it up and pay it to staff quarterly too.

I have no idea why they would deduct any money from your wages for a 'holiday fund' though, don't even know what that's supposed to be.
