I had to go to court once as i was inexplicably assaulted by my girlfriend-at-the-time's next-door neighbour.

It's a horrific experience to have to stand up and state your case and be called a liar by the defence team of the other parties involved.

Best wishes for it all - I hope the scum get their comeuppance .
 
From the sounds of the previous posts, going to court might actually work in your favour. It seems a mighty ballsy move from the prosecution given the facts on the table.
It will get thrown out. You dont owe money for them simply being present 'or in this case not being present' and I will pressure them to prove loss of earning etc through medical reports/work hours logged etc.

Bit of a catch 22 though, as you may end up paying more for a sol/barrister combo to defend this successfully. Depends how much its worth to shut them down I guess.

This, I'd be counter-claiming for every penny and minute wasted on dealing with it, I bet they're hoping to intimidate you into paying up rather than go to court

Unless I'm going a bit mad this is surely a civil case and there isn't a prosecution? His wife hasn't committed a crime.
 
The short version was that as my Wife could not provide definitive proof the driver's wife wasn't in the car at the time of the accident; they would settle her claim as well
and how did that **** prove she WAS in the car?

i think the counter sue for slander etc is well worth it, they probably think you're an easy mark, so a shock like that might scare the sht out of them. frustrating that it's got this far, to say the least, but as others say the insurance people don't seem to give a fk, for some reason. goven this seems to have progressed far into the fraud territory though i'd have expected them and/or the police to be a bit more engaging.
as another observation though, it's yet another example of our phone idiocies. people take 20 pics of their dinner or something else pointless, then the one time it really matters to have a record/evidence, nowt occurs to them.
 
Yikes, quite a spike in replies - hopefully this thread has given food for thought; or at least, a jump in dashcam sales :D

Turns out that the Court letter yesterday, was something the solicitors for my Wife has (seemingly) automatically generated, in preparation - as the 'other side' hadn't bothered to accept the settlement offer. But it seems that Christmas post was to blame, as they got an acceptance not long after I posted here - and it's all done and dusted now. Phew! The lying cow got a shade over £1500 (the minimum this so-called law firm said they'd accept), so here's hoping that she now has to pony up 30% to said 'law firm'!

Whilst I would love for my Wife to counter-sue the claimant, and at least see some justice served - she is just glad this is behind her now, and done and dusted (I told her to get that in writing!). For an accident in early-ish 2017, that was (at the point of impact) cut and shut; her fault as she ran into the rear - the current bandwagon ambulance chasing culture meant that two individuals took an offer most of us probably would - free money! Sadly, they didn't stop to think that it was fraud, and in one way or another, affects us all.

Think I'll be getting my own dash cam, and a GoPro for my motorcycle too - after seeing just how easy someone can stick in a bogus claim, and how little an insurer actually does to verify the claims; having an impartial digital witness is now a necessity I think.
 
I'm so getting a dashcam. I've had to deal with the Court system in relation to a consumer rights issue and I can tell you the stress it causes is just monumental (no solicitor involved for me unfortunately). If I can avoid a similar situation then I'm all for it.
