Any implications from removing 6970 backplate?

I just got a Powercolor PCS+ 6970 to go with my reference 6970 & I thought I'd be better off using the Powercolor as the main card (top slot) as it has a better cooler & I know the top card can get hot. Thing is though, the fans touch the backplate if the second card so I've had to wedge two small pieces of wood in between the cards to stop this. It's still reaching some pretty hot temps too.
I looked into getting an after Market cooler for the bottom card because u wouldn't need the backplate with one but the temps on the bottom card are fine really so it seemed a waste.

Would I just be able to remove the backplate & give the top card a bit more room?

I wish I could just move the bottom card to a different slot but I can't do that as my PSU is in the way of the bottom slot of the mobo (GA-X58A-UD3R in a HAF 922)

Any advice on what to do?
