Hi all,

Just wondering if anyone else here was mis-sold (or knows someone that was) the carphone warehouse 1.99 deal.

Just been back to visit the folks (who are getting on age wise) and my mum was sold one of these contracts last year and told it was only 1.99 a month. Turns out it was a rebate thing - nothing on the contract she signed about how much it was meant to be and she even got the guy to write 1.99 on the form!

After the first month she got her first bill (this is going back last Nov now) she saw she had been charged £25 for that month and has been in a battle with them ever since.

I drove up to the shop and confronted them about their selling practices. Turns out that when they sold the contracts they didnt mention anywhere on the forms what you would be paying, it was assumed that the salesman would give the price and make the customer aware of it in the brochure... This wasnt the case but Carphone Warehouse wont budge and claim all their staff tell the customers EXACTLY what they are signing up for!!

My parents didnt use the phone after the first bill came through so it's not like they were trying to get out of the contract - it was genuinely mis-sold. Trading standards are dragging their heels and Ofcom just say to talk to trading standards!!

Seems like another loss for the small consumer against the corporations :(

Anyone know of anyone else that was mis-sold this way? The cheeky **** from CPW even had the cheek of sending through a copy of the "Original" contract apparently signed by my mother - on which they had CHANGED the wording and added in figures!!! It didnt match the form she signed at all - they doctored it as we still have the original so I can see this!!

I'm thinking of starting a website about it to get some publicity for others that fell victim to slimy salesmen who dont give all the facts regarding chequebacks and are only thinking of commission. Hopefully that way people can get their money back from CPW...!!

if you still have the original contract which has no mention of the £25 it should be a clear cut case as you are signing a contract that says you will pay £1.99 a month, never mind what the salesperson said its all about the thing with the signature on.

I would not think CPW have a legal leg to stand on.

Most T & Cs seek to exclude oral representations. Such a business sale model would not get past the Legal dept.

Any tampering with the original contract is likely to be fraud.

It should say on the contract underneath the details of the tarrif. No idea if it was different last year but I know that for the last 4-5 months it has always been clearly stated on the contract itself AND in the welcome pack that all phones should be provided with.
Besides that the member of staff should have informed them of it, but obviously there's a chance they forgot. Which is why it's always printed on the contract, back up plan.
In 4 different branches that I've worked out I've never seen anyone forget to mention this to the customer (mainly because we'd get into a hell of a lot of trouble if we did), so sounds like you were pretty unlucky.

Seems like the Virgin contracts dont have the tariff printed on the contact speaking to another carphone warehouse. Vodafone/O2 have the tariff and price printed on the contact. Can anyone confirm this? The contract was taken out last year (Sept time).

hmm, if thats what they told you it might be wrong, im pretty sure all contracts should state what you're going to be paying up etc

Yes your right, I work for CPW and thats 100% correct on all contracts the rebate thing is printed for some reason it would never get printed on Virgin Mobile contracts....

Sorry its not helpful but dont know what you can do really as Haly has stated knowing all the stores ive worked in everyone mentions everything, specially in my home branch you have no idea how many Terms & conditions belong to each company....
